I called congressman Hinjosa's office.
The staffer asked me where I am calling from. Then said you are not a constituent of the congressman and was not willing to transfer to the person who handles immigration issues. I insisted on leaving a message and he took the message, but was surprised, did anybody else encounter this? How do we handle this if it happens with other congressmen?

ok, there is a lot of prediction that the dates will move from C to U in the very near future. What does it mean for people who currently have I-1485 applications pending? Does it mean they have to wait until the dates move from U to whatever their PD is? if it moves to U in Aug, I think it will be in Oct when it will move again to sometime 2003 (given the large # they are about to receive).
Any ideas about this?

I got Card Production Ordered mail for my EAD yesterday (08/12/08). I e-filed on June, 1st and gave finger prints on June 26th. I hope I'll receive my card by Sep, 24th which is when my current EAD expires.
Hope you guys get approvals soon. Couple of my friends also got approved on 12th.

Called all offices and left voice messages - read this action item too late in the day to be able to speak to the staff themselves.

Asked me if I belonged to IV - when I said yes, he said they have been receiving quite a few calls about 'those two bills' from ImmigrationVoice. He also said that since they receive a large volume of calls from their constituents as well, they have to be prioratized over us. He however promised to convey the 'ImmigrationVoice's' request to the Rep.

I can tell you that if you have good communication skills getting hired here it's not a problem, in fact they won't even ask you if you're not a US citizen until the end.
I'm from a country in the Americas and I can say that most of the time there are limit for foreigners working in a company.
So its not unreasonable to put some limits.

It is explicitly mentioned that quota is over for "year".
I always thought that DOS issues the visas to USCIS and that this is done quarterly. If this is the case, how can USCIS say that all visas are used up for this fiscal year when we are only in the 3rd quarter? Would they not be obligated to wait for new visa numbers in the 4th quarter? How can USCIS allocate more visas than they actually have. This is strange!

My Attorney has sent in more than 2 inquiries with DOL and each time we get the same boilerplate reply saying you are in queue and we are processing it. This is an automated reply as few of my friends even got the same reply with no change except case number.
Also as for as i know there is no time limit as such as 4 months to wait before contacting DOL.

Here are my thoughts about May visa Bulletin:
The severe retrogression of EB3 has nothing to do with EB1C (if at all this will affect something, that would be spill over to EB2). This severe retrogression is the result of "FBI name check backlog" being cleared up. We never had actual info as to how many of "super old" cases were pending due to this: Now that they have cleared it up over the past year, it seems to me that it used up most of the visa numbers for EB3 during this fiscal year. This is actually a good news for the people who were waiting for almost a decade, but not so good news for the recent filers.
The main uncertainty is: How many more visa numbers would be needed to actually finish this "name check backlog"...we simply don't know; hopefully not too many.
Impact of this on EB2 would be of similar magnitude and therefore, we can consider that this fiscal year got "almost completely chewed up" in clearing those name check cases. For EB2, actual impact wouldbe apparent (hopefully) in the last quarter when EB2 India an china will move toghether (if the dates are similar like last fiscal year; i.e. 2006, then we can say that it took "year worth of visa numbers" to fix the name check mess. At the same time, some of the effect would be due to EB1C, but I personally have serious doubt that it would have changed much compared to previous years (we will only come to know about EB1C impact once the year end stats will be out and if we see significant change in EB1 usage)..
In any case, "EB2 being current in one year" dream of VDLRAO will not come true (I personally supported this thought last year), mainly because of clearing of FBI name check backlog (which is actually a good thing). However, actual impact on EB2 will be clarified only once spill over starts to EB2 and dates of India and china move together.
Any additional thoughts would be welcome.

I am little confused. As your wife is already in legal status (h4) till 09/2007, why do you want another extension when you switch job? As far as I know (I had similar situation in 2003), you can transfer your H1 to new employer and before her H4 expires, apply for extension with your new H1B (it may not be required even as she has already applied for H1).

Just received Card production e-mail for me and wife. Had pretty tough time last few weeks thinking what could have gone wrong as my PD is MAY 15 with everything clear. After waiting a while, 3/4 days ago I had infopass and went to Congressman for help.
Though we are happy but can feel how tough it is to wait and wait....but I assure you all will get it soon, but take action as your intution says as you KNOW YOUR CASE BETTER THAN OTHERS. So take help if you think there is no question of RFE or delay is longer than ususal. Thank you IV and all members. I will contribute, as many of you did after getting it, and stay in touch with forums for anything I can be of assistance.

Yes, the majority of approvals are from 2005. There's even one with a June 2005 PD. I can't understand why it has slowed down though.

I live in Illinois and have to renew my passport at Chicago consulate. My original passport was issued for 5 years only so as per the website, I need to file for "Renewal of short validity passport".

Based on past experience i feel that people will cling to a false hope and make assumptions about getting their GC's. My primary concern is people will stop making efforts to push for recapture or any other relief. The spillover rules are such that EB3-I will not get any additional visas till 2012 (at the earliest). Who knows what the stituation will be then.
We should also be debating why the PD for Mexico EB3 is higher than India when they have more people in the queue before their PD. I would take the numbers with a grain of salt or at the least not forget the past... as someone said if we dont learn from our history, history will repeat itself.

In this visa bulletin atleast they give us an idea of not to expect until the year end, So they are not giving false hope in each bulletin until october 2009!!!
So we all can predict on september onwards. Atleast we should send some flowers for passing this information.
