DISCLAIMER - I am EB3-I with PD of 01/2007 AND I am not porting to EB2....
I DO NOT support this law suit idea but I really admire SunnySurya... not because he/she is planning to file lawsuit but because he/she has been really polite and patient to so many insulting, taunting and name-calling posts "personally" against him/her.
Again, I am NOT supporting actions of SunnySurya..... but admiring the patience and politeness....

Hi Gurus,
Please advice on the following situation. If you file a 485 thru company B as future employment(used substitution labor) and if company A for which i am currently employed agrees to file labor and assuming the dates would be current and labor is approved. Can i cancel the 485 applied thru company B and apply thru company A for which i am currently workin?

.... If there is any sequence after Approvals, expect it this way: CPO/approval ADIT/Welcome mail (mail), Post decision/ Last processing Action= this is the date they mail cards and check/hope to find cards in mail box in 3-4days (DON'T discard as they look so very ordinary envelope....)

I am not an expert but I have a hunch that EB2 India will progress to Jun 1 2006.
Based on your calculations , Experts, please let us know what to expect, if 12000 GC are released for EB2. Where will the cutoff come and stop..

nov 2004, EB2 I still waiting.

finally got FP notices and the appt. date was october 21st. I did a walk-in to ASC and got it done on sept. 29th. So, the cases will have the way cleared up for oct. 1st. There was an LUD on 30th, may be a result of biometrics uploading. No movement after that.
both cases are with same IO as per infopass. senators enquiry came back saying wait for 45 to 90 days. Processing in the order we received them.

Yes, I agree that not filing GC earlier is not an excuse for MBA. The point is he still would have been in the same situation (EB3, 2003 is not too different from EB2, 2005) in terms of how fast he will get his GC.
The law would allow him to port his EB3 PD just like how it is doing now. he will not be in the same situation, isn't this better now?

Sorry to hear this, but what is the violation you are referring to. I thot, L1s can be employed in the US on client projects by consulting companies, big or small. Sorry if i dont understand the visa rules here

I am pretty new to the forum (as a member), I have been browsing the same for quite some time and found it a good source of information regarding immigration related activities. Right now I am getting removed from my project as one of the top 3 Indian outsourcing firm is dumping their L1 resources at my client site and replacing all the citizens, GCs, EADs, H1 etc. These resources are used in projects managed and controlled by my client (most of them are consulting assignments) and these resources are used on java/.net/oracle projects, these two are violations of L1 visa restrictions set by USCIS, I want to know how and where to complain against this violation and we have all evidence to prove the same (project documents, time sheets, work assignments etc). Please let me know exactly and to which agencies we should complain.

I checked with USCIS by calling them and they still have no records for me in the system. They admitted that there are many who have not been entered and issued receipts even though the dates at NSC & TSC shows otherwise.
Adviced to be patient and call back in October 1st week. According to them its still not long enough for them to launch an inquiry to find these July 2nd applications.
My lawyer also says she can't do anything yet unless they say that they have filed everything they have received.
Again what a mess ...waiting for reciepts takes so long wonder when they will finally process the GC.
I know many 2nd July filers who have even received EADs.
I hope our patience pays off and they rewsrd it with giving the GC straightaway;).....wishful thinking.....

1. What are my options so I can take advantage of the PD being current for me?
2. can I apply for I-140 and I-485 and then apply her I-485 when she returns?

I just called CS of Vonage and asked them about 5k minute limit. They just laughed as I was not the first one to ask. They said for residential Vonage world plan there is no limit. those 5k applies to business . So rest assured and call India without any fear or limit. Unlimited !

This is the reply from Attorney Murthy on a question asked on Murthy chat about filing two employment based I-485's for the same beneficiary (not the husband/wife situation).
"Generally it is safer not to file 2 separate 485s since it can confuse USCIS since they may assign two separate Alien or A numbers to the same person. This could end up delaying the person's I-485 approval down the road or create a security delay in many cases with multiple I-485s generally we recommend one case to be filed as an AOS and the other for CP if possible."
If you have other answers from lawyers, you can post them. Make sure to post the lawyer's name. Do not post your opinion. Post legal advice given to you by your lawyer, with the lawyer's name. This will help members get accurate advice and not opinions.

the first contact for the congressman's office is the relevant consulate. so it doesn't hurt. it is a simple process. your boss has to sign a confidentiality release document for you and attach a cover letter. to help your boss, identify the congressman, go to the congressman's website and find out where the forms are, write a draft cover letter etc . you can do this yourself i.e enquire as a constituent just in case you don't want to involve your boss. i think it may be better that it goes through your boss

It is really better. He can recapture his old eb3 PD after getting approval for eb2 based I-140 for the manager job.
Law provides equal opportunity to everyone for PD recapture. This is my point.
And, for those who are going to argue that no one is going to file GC for him in 2003, this is not a valid legal arguement. Granted, it may be a emotional one.
On a related note, how many people REALLY agree that GC is for the future job? But they never dispute that in court of law because it does not hurt their case. Anything that hurts their GC cause makes them victim and root cause for gaming the system.

Unfortunately these guidelines specified in the memo haven't been adhered to, during processing of I-485’s in cases where the sponsoring employers revoked I-140 petitions.
Please make this small correction in second paragraph. The "to" in bold is missing.
Please also post the names and addresses of both California and Vermont service centers as it is not clear who would adjudicate the thousands of I-485 cases they are sitting on.

I think the division of Eb2 and EB3 will be over when oct VB comes. Mostly Eb3 will go back 2003 or 2004 and Eb3 date may be 2002. At that time there will be unity.
