It is good that you shared yr experience. I always avoid a country which needs transit visa. everyone should fwd this email so that such countries are forced to change rules. best option nowadays is to fly from NY which have direct flights

I think having vonage is more than just about calling india and the calculated rate of a call per minute.
It gives the customer a home phone too. Remember not every household functions with only cell phones.
So for the convenience of having a home phone and being able to use that same phone for international calls too and getting just one flat rate bill for the whole thing is certainly of value to consumers.

Congratulations to all those who are finally getting their GCs after a month long wait (a much longer wait, I know). :)
I am beginning to find out that having your priority date current does not automatically mean GC. It is just another waiting area where it is another lottery game. When you are not current, you know there are a lot of people going thru the same thing, and you hope that one day dates would be current and that things would be fine. Unfortunately I dont feel that way now. And strangely, it feels kinda lonely here in CurrentLand!

My PD is 12Jan2005, EB2-I , NSC. I have already talked to two IOs using POJ method. The first one (was very nice) told me that my case was in transit to an IO officer (she said that it was an intra-office transit) and that I should give it 4 days. I called back one week later (on 10/8/2009) and this time did not get as nice a lady - she said that may case was waiting to be assigned to an officer and that I should wait 90 days. I dont know which one to believe or if I can believe both.:confused:
A few questions:
1) Should we contact senators or congressmen, or both? What is the recommended method to contact them - through phone or through snail mail?
2) I understand that there are still many people before my PD that are waiting for their GC and I wish them the best. Should I give myself more time (say till the last week of the month for others before me to get approved) before I try the various approaches that Kewlchap and others have suggested? Or do you recommend trying all the approaches one by one right away?
3) For form 7001, do you think it should be treated as the last resort, or will I be able to save some time by starting with this? Is there any advantage if the attorney submits this for me?

Got the email about being registered as a new permanent resident on Oct 8th. Thanks to SoP, caliguy, fatjoe and all others on the forum who helped / gave me support. I essentially learned that USCIS will not move quickly on their own, they need to be pursued just like any other govt. office in India. I give my time line below for an idea of what I did. If anyone is waiting still, I sincerely think that you should do all of POJ/SR/Infopass/Senator/Ombudsman.
Timeline:
Sept 1st - became current
Sept 5th - contacted NSC several times through POJ. Finally, a very nice lady told me that my case was not even assigned to an officer. Said that she will send in a request to the contractor to pull my case out and get it assigned to an officer.
Sept 11th - Case pulled out of storage area and moved to a smaller waiting room [got this info later, but this is what had happened]
Sept 13th: Opened SR.
Sept 18th - Infopass: Told me that my case was assigned to an officer on Sept 11th (which was wrong really) and that I should wait 30 days. Also told me that my FP were renewed on March 9th and all my checks were clear.
Sept 20th: Contacted Senator's office. Said they will send in inquiry.
Sept 25: Response to SR. Case under review. Wait 30 days.
Sept 27th: Letter from Senator saying my case was under review and I need to wait 30 days.
Oct 2nd: Contacted NSC again through POJ method. A nice lady, Terry, told me that my case was assigned to officer on Sept 30th. She said, "your case was pulled out of storage and put in a rather large holding area where it was till Sept 30th." Also confirmed that my FP was renewed and other checks were clear. Said, just wait, it will happen soon.
Oct 6th: Sent 7001 form to USCIS Ombudsman.
Oct 8th: Got decision email.
Learnings: Pursue your case as much as you can. Call NSC, but be polite. They are usually in good mood on Thu/Friday evenings and if you make some small talk, they will help you. I kept records of which NSC IO is rude and if they picked up the next time, I would just keep the phone down. In fact, the lady who helped me remembered me 'coz I managed to reach her 3 times. Dont just ask for status, say that you have called in the past and so far you know xxxx about your case. Some IOs are nice, some are rude. Nice ones actually tried to explain the entire storage area, holding area, supervisor supply chain to me. I think I kind of understand the process that happens at NSC just through these conversations now. Approach Ombudsman asap with form 7001. Call your Senator office and ask to speak to the immigration person. They are very understanding and will help you.

My current situation is that my wife and I applied for 485 separately.
my wife's PD is 2007 ( 485 applied in Aug 2007 )
I applied for 485 in Oct 2007, Since my PD is 2003 and is current as of now ( my 140 is pending ), I talked with our companys lawyer on what options do I have with regards to my wife's 485.
My lawyer suggested 2 options.
1. File 485 again for my wife as a spouse derivative. As per lawyer, this is very common and has experienced with these kind of situations.
2. Instead of filing a second 485 for my wife, just write a request letter to move her pending 485 to my 485 as a derivative. If this porting is successful, she cannot move back to her own 485.
I know some of us have gone with option#(1), but since option(2) involves very less paper work, did any of you have used this option so far?
I am confused as to which one to choose. My lawyer spelled diplomatic when asked about which option is better/safer:-)

I can understand your frustation. I am not sure, but at times I feel if all the pushing and prodding we have done has pi$$ed off USCIS. I mean, what would it take for them to approve or look at our cases ? What am I missing?
I had infopass this morning. The IO was rude and repeated everything I knew. He even said I became current only last month, did I expect to be approved in less than a month? When I told him that pretty much everybody who was curret (and after me) had been approved, he told me how does that matter? I wanted to ask him, what happened to my number in the queue and following the rules of the game?? Last year, USCIS went by receipt date, and not PD. What are they going by this year??

I don't think the call was anything big deal.....it was more a courtesy call an image improving call...we were not told anything that we didn't know already.....USCIS always raised more questions than answering them.......

I think it is the part of their process. I went an infopass the other morning and the IO gave me the same response. She said every thing was fine with my application. It was pre-adjudicated and now waiting for a review now that my priority date is current. She asked me to wait for 60-90 days. But I got the approval same afternoon :)
Today I and my wife had an infopass appointment and were told that our I485 case is in Adjudication review and should expect an interview soon. I asked the officer is there anything wrong and he replied back that everything is fine. I am not sure what adjudication review is and why there is an interview if everything is fine :confused:
We also opened SR on 9/1/2010 and I got the response today for the SR request and it has the following details

So thats just somebody's interpretation of letter campaign. Perhaps one of the enthusiasts over here should post something over there differentiating the goals of the letter campaign from illegal immigration along with all the arguments posted here and explain that their interpretation is incorrect.

If your PD is current for the July bulletin, then your application has to reach on July 2nd which is a Monday.
If your application was to reach on Saturday, June 30, and if the mail room guy is working overtime (assuming that the hell has frozen over), then your application will be sent back soon enough. Of course, the mail room guy is not going to open it on the same day; he/she is only going to stamp the date. And then when they really open it (2, 3, 4 weeks from now), they will send it back to you.
If your application was to reach on Sunday, July 1st, and if the mail room guy is working overtime (assuming that the hell has frozen over AGAIN), then your application will be accepted.
But if either of the two things above happen, I am not sure that GC is going to be my priority since hell would have frozen over...and I believe that's where we currently are stuck! :-)
So just take a chill pill, guys, your lawyer should know that the application should reach between Monday, July 2nd and Tuesday, July 31st. The end date can change once the August bulletin comes out.

I am surprised that all other threads are getting updated quite frequently. People are posting question related to their RFE and as usual once they get answer to their problems, they vanish. People are posting jokes on IV, but when it is their turn to call, we've to "bump" this thread and send e-mails to members. So pathetic.
I felt very sad when I read 30000+ members donated some 4000 dollars in last two months. I felt my donation of about 1000 dollars since 2006 is being wasted to answer questions of or to solve the problems of these free riders &/or one question members.

Folks, first of all don't try to slam me for posting this.. Here is a note that I got from my law firm Paul Hastings.. I am subscribed to their immigration related email.. I got this today.. While this has come as a shock to me, they are still preparing to file my I485.. I did not hear this from my lawyer personally, but only through this newsletter. I will speak to them about this first thing monday morning. Please read the note entirely.. Has anybody else heard about this..
Update on Adjustment Filings for July
Yesterday, we distributed a Client Alert reporting widespread concern as to the accuracy of the Department of State's (DOS) Visa Bulletin for July 2007 and indicating the possibility that United States Citizenship and Immigration Services (USCIS) may potentially not accept adjustment of status filings for all, or a part, of July. Today, multiple reliable sources have indicated that, as early as Monday or Tuesday of next week, the DOS could issue a revised Visa Bulletin for July 2007. Most likely, some or all of the employment-based immigrant visa categories would again retrogress and may become completely unavailable. The practical impact is that USCIS would almost certainly stop accepting adjustment applications for filing if the revised Visa Bulletin indicates that immigrant visa numbers are not available.
This unexpected development would deviate from many years of agency practice. It would be devastating for companies and foreign national employees who have relied, as they are entitled to do, on the July Visa Bulletin and were anticipating the filing of adjustments throughout the month of July. We have initiated a concerted effort to aggressively address this unprecedented situation through the highest levels of the Department of Homeland Security (DHS) and the DOS. We are joined in this effort by many other organizations, and we are engaging congressional offices for assistance. Many have already agreed to speak with DHS and DOS. We will keep you updated.

We have initiated a concerted effort to aggressively address this unprecedented situation through the highest levels of the Department of Homeland Security (DHS) and the DOS. We are joined in this effort by many other organizations, and we are engaging congressional offices for assistance. Many have already agreed to speak with DHS and DOS. We will keep you updated.

Would anyone be able to advise if I can travel out of the country after I've filed the 485 if I have an approved I-797 approval notice (for H-1B) but old H-1B stamp in pp has already expired?
If I travel out and then get the H-1B visa stamp at an outside consulate, I would be able to travel back in, but would I have considered have abandoned the 485 application? (since I travelled out without a valid H-1B stamp in pp)??
Can I travel out even before my AP arrives? Or does having an AP make a difference? I would prefer to stay on H-1B status since you never know what happens to the 140/485 application.
