EB-3 ROW: 1 Mar 2006
PD cutoff date moved by 9 months. this is great news for PERM applications with PDs in late 2005. this also tells us that the state dept will move cutoff dates significantly in the last few months of the year so visas will not go to waste.

As pappu stated in the first post of the above referenced thread - some of the ongoing efforts include finding how many IV members would get benefit from such a provision and get basic details such as username/Priority Date of impacted members. Future action items might include drafting documents and letters to support this provision. There maybe actions such as sending emails etc. However we would not be able to open a public action item unless we can have thousands of our members willing to participate in a grassroots action item. This survey intends to understand the needs of our membership for this provision and collect grassroots information.
The fact is we have a dedicated group of volunteers (and we need more) who have been trying their best to spread the message about this initiative so that a strong grass-roots support can be created leading up to launch of the public action items. So far we have around 1100 people who have responded. Based on quick calculations carried out using PERM data, it is estimated that there are at least 60K-70K EB applicants waiting to file I-485/EAD/AP (this is a very conservative estimate..the actual number could be much more). Grass-roots initiatives require time and patience and we request maximum number of impacted folks to participate actively.

Let me tell you what will happen if you don't contribute now:
With the number of people who have contributed stabilizing at a low level, IV's lobbying will be very very limited.
Then people who have contributed would feel disappointed.
Sooner or later, those people would withdraw their contribution.
Eventually IV will be closed.
From then on, you, who don't contribute now, will have no organization to speak up for you.
From then on, you will complain your situation in your company, seeing your peers get promoted while you get stuck in the same position because of your GC application.

Maybe, at that time, you will say to yourself, "if I have contributed to IV in that special year, if all people like me have contributed, we would have get our GCs. Then, maybe, my life would have been totally different..."
Let me also tell you what you can lose if you contribute.
Your immigration status will NOT become worse, if it cannot get better.
The only thing you will lose is about $200 or less if you contribute $20/month. It will happen this year or never! If it does not happen this year, you can always withdraw your subscription.
I believe many people would pay $20,000 to buy a GC if possible. If IV brings 1% chance to help pass the bill, $200 is a very fair price! Besides, I believe the opportunity cost for people who has no GCs is probably more than $20,000 a year, considering a potential promotion or a job change. For those people, don't you think $200 is a very reasonable price to buy yourself a 1% chance?
Besides, the chance that IV brings to us is much much higher than 1%!
You are all high skilled workers. You can do this math very well!

Agreed lets not bash illegals in public. My point is 'legal Path' for illegals has just become almost impossible with the current congress and senate configuration.

Inshkrish you have two RDs I mean you are July 2 filer how come your RD is in Aug, ND is in October so technically you are out of the processing window (but are you???)
My PD is close to you....but no movement ..........

I applied for H1B and Change of Status in April 2007 and got approval for the same in August 2007.
I have to go to India so, I want to know Can I Travel outside US and re-enter on H4 visa (which is valid till 2009) before October 1st?(Before H1 becomes effective)
I am aware of the fact that you can not travel outside US while your application is pending. But in my case I have the approval. So is it possible?

You can come back to US on H4, but you may have to apply for change of status from h4 to h1 again, to be able to work in US.

Took about 3 weeks. I submitted everything by courier to Houston CGI. I did not get any message saying that they had recieved the passport or that they had started; after 3 weeks the return courier just magically had my new passport.

If someone is responsible for the current state of affairs in the H1B area , It is Indian firms . The H1B1 was started in 'GOOD FAITH ' by United States to help people from "all over the world" to come in and work in the US , but large Indian IT houses have overexploited these loopholes so much that we are currently in this sorry state of affairs . In their greed for higher and higher profits(every Indian firm hits 30% profits every quarter ) they have spoiled a perfectly working program a few years ago to such a state that now getting an H1B has got less nothing to do with talent but has become like buying a supperlotto ticket .Below is a very good article from the "Economic Policy Institute " that highlights the fact that 2 well known Indian firms have single handedly lapped up 65% of H1B visas last year and have applied for just 69 green cards . Thats a GC application rate of 0.0004%. i Cannot help agree with the facts in this article. I totally agree that firms like these which abuse the system ought to be severely punished and blacklisted, so that geniunine US companies can get their required workers , when they need them . From my experience with trying to convince EB applicants to join and contribute to IV, I get the impression that most of them suffer from a 'subsidy mentality' - they hope others' efforts and money will subsidise their GCs, just like their home countries subsidised their education. Sorry, that mentality just wont carry us too far in America, the temple of capitalism. It is up to us to solve our own problems - no one will feel sorry and wave the magic wand for us.

Income from investment activities is okay on any visa status as long as appropriate taxes are paid.
If one has rental income, interest income and captial gains from the stock market while on H1-B, does it affect if the person transfers status to H4. Is income from above sources for a H4 person ok ?

It was great meeting and working with everyone especiallyJay,Aman,Himanshu,Vandana,Prateek,Nilli, Vandana,Mark,Tamsen,Puneet (yes- I am being nice to you inspite of the lawyer jokes u crack at my expense!!!),Anil,Sanjeev,Rajesh, Macaca (yes I was a bit too hard on you :) but it was all in good spirit) and of course my friend Meenal. I just want to thank a few volunteers who worked on lobby day meetings with me but could not attend the lobby day or the rally day-Fora,Vasu and Payal. We are all so glad the lobby day meetings and the Rally went well. It really shows what we can do when we all get together. Kudos to IV and its members!

right. in the AILA call also they cautioned that retrogression will become worse (dates moving back!) once USCIS starts processing all those July/August filers...
Once USCIS completes data entry of all 800K 485s (may be with in next month) they will have clear picture. They may give a report to DOS, how many waiting in each catagory (EB1,2,3) with PD with countrywise break out. Then DOS will easily setup the cutoff dates. This may happen in Jan or Feb.
I feel that EB3 India may stay like this (in 2001). EB2 India may go back to 2003 or 2002 , based on how many guys in EB3 with PD 2002, 2003 converts to EB2. All other countries may see slight forward movement.
