Since the forecast is EB2-I will be current in a few years. Does that mean that someone with a PD of 2009 (EB2) would get the GC faster than someone with a PD of 2004 (EB3)?

Spatial, I agree with your views. There is nothing in INA which clearly talks about how the spill over should be allocated. USCIS is acting on its own whims and fancies. In last months' visa bulletin they mentioned questions were asked on how the spill over was allocated and decided to make it horizonal instead of the historical vertical spill over. So I am sure we should get some concrete answer how they decided to change it. Based on what ? which clause of INA states that ? I think we should all write letters to Mr. Oppenhiem demanding explanation on the same.

I never watch Lou Dobbs since I am never home in that time slot. But had a chance to switch to his program last week. Actually I did not want to see him but wanted to see which companies are sponsoring his show and would like to lose me as a customer.
Travelocity lost a customer in me. (I had a mixed feeling on this. When I used Travelocity the last time and I needed some customer support, the Travelocity person who tried to help me was an outsourcing company person in India).

i do not think IV core is on a vacation.
From what i gather, this idea was tried with lawmakers before.
But to change citizenship laws is far more difficult than changing the quota cap of a (GC) process.
Never-the-less, we should not give up.
Say, in the bargain for citizenship after 10 yrs of Legal & crime-free stay we get GC instead, still a deal.
Can we have a plan of action as a consensus?

I wish I had all the data on his reporting for H1B visas. He always makes it sound like there is unlimited H1B visa available for foreign workers and nothing can be further from the truth.
I hate to watch his show anymore but I'll from now on just to report the lies and inconsistencies he reports in his program. Let's do a "Expose Lou" campaign. I would love to spend any free time I have on this noble cause.

So USCIS will never see the flowers becoz they are boxed.. and they will never get delivered becoz they are being routed from the airport itself. No major news media covered the few deliveries at USCIS.. What was the point of the campaign again?
In the past week, the "Protest Blooms" campaign notched up the following wins:
Times of India article
Buzz in the blogosphere
Attention from many attorney websites and blogs
Had a Washington Post journalist show interest in our issue and had tens of our members talk to her - which should result in a good article. How many times have we seen so many regular members of IV being able to speak to a reporter of a mainstream US publication on our issues?
Had a senior Reuters editor talk to many of us and he promised a sustained coverage of our issues
Had a senior reporter from New York Times talk to me
Had the footage of this entire event shown on CNN in India
Had many small media outlets which never cover these kind of issues, cover it (in smaller towns in MN and NY)
Created a sense of action in the community which was feeling pretty dejected after the USCIS fiasco
Had USCIS director react to us
Had so much interest generated that the IV website was brought down ;)And all this was accomplished with a severe time crunch.

Would it have made for better visuals if the flowers were in full view? Sure. Is there a way to improve upon every campaign? Sure.

I am surprised by the disqualification since the Department of Homeland Security (DHS) had issued the EAD. DHS has set clear guidelines not to discriminate based on any of the authorized work documents issued by them, EAD being one of them. The I-9 form required to be filled in by every employee (citizen or otherwise) clearly mentions this.
Are you sure CapitalOne does not allow candidates who are on EAD specially when it does not require sponsorship from the employer ?

After reading the other thread link that BharatPremi had posted earlier, it seems there is a possibility that they could claim that they don't want to do sponsorship (which is legal to say so), and hiring an EAD candidate means they may have to do some amount of sponsorship, however small it might be (like providing the correct form of employment letter etc).

Fortunately I didn't have to go through all your pain before deciding never to fly via London.
The worst airport, dumb and pointless procedures (before the "invention" of transit Visa) were enough for me to decide. I can't even imagine filling out a form and pay to pass through that horrible airport.
I pity those who travel with kids. Those kids may never want to fly again.

Please don't give much credence to 'conspiracy theory' posts by paranoid folks like H1bmajdoor who live in fear of their own shadows. Neither do they understand the difference between a law AC21 and regulations ( USCIS frames these) nor do they care to learn. Their ignorance causes them fear, and fear causes them to act irrationally.
It's best to ignore such losers who beam negative-energy. Their penchant for inaction is a self-fulfilling prophecy that dooms their life. Nothing will happen to them in life, as they don't do anything to make things happen! . Don't join their league.

Hi,
My company's attorney filed for my PERM and I-140. After I-140 approval the attorney kept the original I-140 and sent me the courtesy copy of the approval. I am now going to file for my I-485 on my own.
My question is -
Can I make a photocopy of the courtesy copy of this I-140 approval and use it to file my I-485?
P.S: Courtesy copy is NOT the photocopy of the original I-140. It is a copy that USCIS sends in addition to the orinial approval.

since a lot of people are debating on this issue and a lot are researching on it ( i know atleast 2 people are actively researching on this topic :D). Does any one know how can i find the status of my PD porting. My lawyer sent the request in June after 3-4 days a say LUD on my 485/140/EAD/AP. I filed my 485 on July 2nd 2007 with a ND of August 17 2007. My EB3 PD is oct 2003 and my EB2 PD is July 2006. Do you guys think the LUD was because USCIS has Ported/interfiled my PD, Is there a chance for the Green in next 2 months?
I think the people who are trying to file the Lawsuit must be the most knowledegable people about this issue, Can you guys provide some +ve response for a change.:D

How would it be to forward the media coverage links to all the attorneys so that they are aware of what is happening and also provide some kind of support or atleast get associated with IV. Also some members may take the initiative of posting these links to thier blogs so that every one will get to know about the IV through others blogs.

I'm not sure whether USCIS ever *appologized* per say but the second paragraph from the link above supports my earlier argument that the new spill-over policy (which in my personal opinion is more rational) is not a random, ad hoc decision by USCIS but rather a careful one after consulting congress etc.
