I changed job early this yr and my new employer is working on labor for me right now. But from my previous employer I have PD of Aug 2005. If I get my labor cleared in a month, i should be allowed to apply for 140 and 485 since other fellows from 2007 pd were also able to apply recently.
Why should i suffer because of USCIS foolishness in Aug.......after having PD of 2005.............all similar cases lets raise our voice.

I would suggest our discussion with the congressional staff should focues on relief in two parts. Many in media are reporting that there is going to be another stimulus bill after healthcare reforms.
So we should try to get waiver on green card quota limits for buying a house. We can make it part of stimulus bill.
All other things including termination of country quota, racapture, exclusion of dependents can be part of CIR.

So Monkeyman, once a person comes to US, he/she should never complain, obey the orders and become subservient, and if treated like dirt, should still shut one's mouth. Looks like you are happy to be a slave to the system!!
Personally speaking, these INDIAN (yes thats with caps) body shops are the reason of H1B abuse. But what can USCIS do if there are crooks sitting in Hyd selling H1Bs for few lakhs.
And people have either become so naive or are really desparate that they fall into their traps as was evident by some lady on murthy forum who incessantly advocated that one needs to get H1B before looking for a job!!

quick question ..did u efile - when and is yr FP over. I agree wait for 7 - 8 days more ..keep checking LUD's ...also did u get "card prod ordered email".
yes ..it is erratic ..but once they figure out the problems, I think people will get cards faster. I wonder if everyone opens a service request then what effect will that have (I am sure customer service people don't like that and maybe the service centers will start working faster ..).

It is good to see the combined Immigration community efforts are bringing results. However, it appears that no attention is being paid to raise the issue of children ageing out because of visa retrogression and delay in labor clearance. The Child Status Protection Act(CSPA) passed in the year 2002 hardly provides any relief to I-140 based immigration petitions. While for I-130 (for US Citizens) applicants the date of child is frozen on the date of submission of I-130 form it-self, but for employment based immigrant applicants this Act provides a complicated way to calculate the child�s age and it just provides relief for any processing delays in 1-140 clearance only. It just ignores the fact that we have years of retrogression for employment-based category. At the time when this act was passed there was no retrogression in employment-based category and lawmakers perhaps never thought of hardship, which children and families may face because of the retrogression.
We need to raise our voice on this issue too. My son is going to miss out the chance of getting his green card just because his age works out as per formula given in CSPA Act to be 21 years and 12 days � because of 12 days my family may be penalized to be separated from our child whereas no one is going to consider 3 years delay in labor case in my case and then another 13 months we have to wait for filing 1485 after approval of I-140. Mine case was the most unfortunate in the sense that I got my I-140 approval in just 29 days whereas in all cases the normal time is 3-6 months. Had it taken 2 months, my son would have got the benefit under CSPA.
I hope some one from Immigration Voice leadership team will take a lead to highlight such issues also before the law makers.

I faced this situation a year and a half ago and transferred my son to an F1 student visa. As long as he is registered for 12 credit hours in college he gets to stay in the US. This is NOT a long term solution but there are few options available. We have to hope that somebody somewhere who can change things will finally see this as a problem and act on our behalf. I have contacted dozens of senators, congressmen etc etc and in all but two cases did not even get an acknowledgment.

Child Status Protection Act and Status H-4 Reaching 21 Year of Age
Question: I am Chemical Engineer who filed concurrent I-140 and I-485 last July. My wife and a child also filed I-485 applications as dependents. I am in a H-1B status and my wife and son are in H-4 status. We all have received EAD and Advance Parole. We are Indians suffering from the steep visa number retrogression. The problem is my son is reaching 21 years of age by March 15, 2008. Problem is his nonimmigrant status. I wonder whether he can keep his H-4 status even after March 15, 2008 since he is considered under 21 years of age under the Child Status Protection Act. Otherwise, he will lose H-4 dependent nonimmigrant status. Does he have to change his status from H-4 to F-1 student status?
Discussion: The Child Status Protection Act is intended to preserve family unity which can be forced broken as affected by the backlogs in the immigrant visa petition processing and adjudication. This law is not applicable to nonimmigrant visa proceedings. Accordingly, once he reaches 21 years of age, he will lose the H-4 dependent visa status. On the other hand, he is not eligible for change of nonimmigrant status from H-4 to F-1 student status because of the immigrant intent that is not acceptable for a new F-1 nonimmigrant status. I do not see why keeping a nonimmigrant status becomes such an issue in this case. Under the immigration law, the alien is authorized to stay in the country pending adjudication of I-485 application. Additionally, pending I-485 application, he will continuously obtain EAD renewal and Advance Parole. Please let him to carry on his life as an adult.

One question: in one thread you mentioned you've also got canadian PR. I did apply for canadian immigration, got approval but have to land before 24th april. My 485 was filed in july 2007, EAD, AP aprpoved and PD for october 2005 got current in the May bulletin. I am thinking of abandoning the CA PR as even if I get that, I will have to abandon it when I will get for US PR. So the question is, what will the CA PR benefit when you already have GC?

Hi Guys,
Need some advice regarding two stocks.
1) USO -- ETF for crude Oil. It is at about $29.00 but alst year in July it was about 120. IS it a good investment bet. I know I might have to hold it till summer of 2010.
2) HNSN -- Biomedical device maker. It is the next ISRG, as the reports indicate. They make the sensie robotic cartherer devices. No one else in the world does that. What do you guys think of this ? It is now at $4.50, at its peak it was about $37.00

Hopefully the new people at DOL will stop over-scrutinizing PERM filings and let the processing time go back to normal levels! Let's be optimistic!
It has take mine for eight months now...since May 2008 (got audited). I really don't know what else can be done to make the point to DOL how frustrated it is to wait for the lengthy PERM process. I am sure many are still waiting and their caes are back to July - Aug 2007.

It seems sun didn't rise from the east or has it....the miracle has happened....after 10 years and 25 days in this country with 2 advanced degrees and with days of ups and downs ...days of confusion and frustrations I finally received a mail:

We have a lot of ground to cover and only 154 members have shown commitment.
The whole retrogression is very depressing if you were to look at numbers and predictions based on the numbers. This is the reason we need to work harder and contribute our time and money for this effort. If we cannot do it this year, then we can easily forget getting a greencard for the next 2 years and more. There will be no immigration bill next year due to presidential election.
This is all the more reason for us to go all out and get the immigration bill passed this year itself. We need all members to help in this effort. We have a strong membership of around 8500 members we can count on for support. However it is sad that only 154 members have thus far contributed in the past 1 week despite all the effort to raise funds. IV is prepared to go all out and get the work done, the question is ARE YOU?
