Quick question.
IV has asked for 2 copies, one to the President and one to IV. Couple of questions on that.
1) Does the letter addressed to the President need to be in a seperate stamped envelope?
2) What is the reason behind 2 copies?
eb3_Nepa, definitely the letter to the President has to be in a separate stamped envelope and hand written is preferable.
Reason behind 2 copies is that IV also want to collect the copies of all the letters sent out to the President. So that when we talk to the administration, we can show them how many folks are being affected because of this GC retrogressions.

Yup, you got it buddy......my point is more from a general perspective than any individual scenarios........and sledge_hammer.....I am well aware of the risk associated with every investment - I do own a house and am paying monthly mortgage installments even when knowing that my investment is at least 100k under water :)......so I perfectly understand the risk that comes with any investment AND i am not blaming my lender for giving me money - as I said before, I could afford it then and I can afford it now!
I am against this 'nobody saw it coming' and 'too big to fail' business - banks very well knew what was coming and what would it's effect be; they still went ahead and irresponsibly gave out money to people who can't even afford an eat out at Mcdonalds!!!! Nobody should give any bail out to these guys - let them suffer for what they have done; if I am acting responsibly for my deeds (paying monthly installment because I signed up for it) the same should apply to these banks - they should be allowed to fail simply on the fact that they didn't make good business decisions!

StuckHere: As a backstop, do you have AP in hand? If yes, my attorney has recommended sending a letter withdrawing your H1-B stamping application to the consulate where you interviewed. Then with a copy of the letter in hand, and with your AP, seek to reenter the US on your own terms... Good luck...

I concluded the same ( Though never posted that analysis :)) But It looks like we are missing a very critical point - we are assuming that " these pending numbers are the total 485 workload USCIS has" but I referred a different chart on USCIS board and it looks like there is a separte hoard of "preadjudicated" applications already sitting in a queue apart from these numbers. Please check on following link.

50% rule applicable only to an organization which has more than 50 employees.
Since most of the consulting companies employees strength is less than 50 ( I believe) the rule of 50% rule will not be applicable and they can file application till they reach 50.

It makes sense to file concurrently only when PD is current. Otherwise it is like applying for your citizenship before getting your GC!
In other words I do not understand why your lawyer wants you to file concurrently when your PD is not current. Just to collect his fees? Maybe. He is at least right aboout the fact that USCIS will do nothing with your I485 application unless your PD is current. So I would just wait till your PD is current. You can still file for your I140 and wait for that to get processed.

Quite simply put EB3-ROW << EB2-I,C. So there is a faster chance of EB3-ROW going forward and being current before EB2-I becomes current. Therefore, with all other categories satisfied, it boils down to EB2-I/C and EB3-I/C. Thenceforth, as USCIS has indicated, the longest waiting PDs will be given the roll-over numbers, which is EB3-I.
So what will be the flow? I guess the following
EB1-> EB3-ROW (until current)
EB2-ROW -> EB2-I/C
Once Eb3-ROW becomes current
EB2-ROW -> EB2-I/C
EB3-ROW -> EB3-I/C
EB1 -> older of (EB2-I, EB2-C, EB3-I, EB3-C)
Please note, this is not going to be a quick fix for EB3-I. We are lowest on the totem pole, and barring legislative action, the only relief we can have is "earlier access" to numbers. At first, I thought my friend was just scaring me by suggesting the senator/congressman route, but seeing your case now I feel foolish as I should've been doing this in early January. I will check my status tomorrow (monday) with the Delhi consulate once more, and then, if need be (fingers crossed), will talk to my boss in Houston about your suggestions regarding congressman's letter. By the way, what if I call DOS tomorrow and they say the I've been cleared, would it still make sense to have congressman approach them? Too many questions, I know, but I guess you know this feeling. I cannot renew my Driver's License if I don't have a valid work permit. I doubt whether the Receipt notice is enough for the Drivers License office to issue a new DL. I changed my employer and the new employer may ask for a new one. But I'm hoping that I might get one in less than 3 months. Let's see

IMHO you misinterpreted the memo. An employer can definitely choose not to hire based on immigration status. This has happened in the past (circa 2001) and evidently many employers do not hire H1B or any employees that require "job related" sponsorship. From the same link, in the next para it says that employers can clearly specify that they will NOT do sponsorship without violating the law. The only question is what is considered a sponsorship, any restricted position (in terms of job responsibility) can constitute a sponsorship (where by employers have legal burden beyond what it takes to hire a US Citizien/Permanent Resident for the same position). H1B definitely falls into this category and EAD borders that category. I am not an expert in labor laws but my experience says that employers have too much control on who they want to hire they can get by with almost anything. The biggest hurdle against any law suit is, EAD is an obscure document with very little clarity about rights that come with it and its usage. It was supposed to be an interim document whose usage only now is becoming main stream. May be one law suit or precedent will clarify it all. But once again employers will get by it the same way they get by with age, ethic, gender and racial descrimination.

That does not mean that refusing somebody with EAD is also legal. Your assumption or conclusion about that is not true. As soon as you use EAD you lose your H-1 status. EAD is not tied to H-1Bs or EB immigrants. EAD is issued to a whole bunch of immigrant types including refugees, FB, etc. There is no sponsorship required to hire somebody on EAD. A letter of job duties is a whole different story and nothing to do with hiring practice.
There is nothing obscure about EAD. Employment Authorization Document - if you have it, its valid for work anywhere in the US. Whats the use of EAD if employers won't accept it? What you say about EAD's usage becoming main stream only recently is not true. We need to start thinking outside the box of EB/H-1B, and so should the recruiters. It maybe true that the IT recruiters who normally hire people on either H-1B or green cards are now having people with EADs. But they are ignorant and they are breaking the law by having a policy to not hire somebody on EAD.

But they CANNOT pick and choose based on nationality, race, etc. Same way, as per Federal law, they CANNOT choose people who have only green card and reject somebody who has an EAD. (See the question from FAQ I posted earlier). That is crystal clear discrimination as per Federal law.
The only thing that may create a problem is if the DHS and the Federal law treats a EB immigrant with an EAD differently than a FB, refugee or other immigrant with an EAD. (I had asked about this earlier)
I appreciate that you guys bring out opposing views but I am saddened by the attitude of our community of being helpless and not believing in our rights. It bothers me to know that the highly educated members of such an affluent community will surrender without even trying. This has nothing to do with the state of labor market. Wake up folks! The Federal government has a whole agency to protect people against such discrimination, and we are here speculating on nuances. If somebody denied you employment on EAD, just talk to them and see what they say. You don't need anything in writing.
