    I think Meera Shankar needs to be fired. Its bloody 2010 and this is the kind of customer service the indian consulates provide - they dont pick up calls - it takes them a month to issue new passports - Always feel ashamed to be an indian any time I have to deal with these useless consulates.

    The Houston consulate does not even have their address properly listed on their website.

    This is what they have listed

    1990, Post Oak Boulevard,
    # 600, 3 Post Oak Central,
    Houston TX 77056

    So what is the correct address ?? Is it 1990 Post Oak Blvd or 3 Post Oak Central ?? Bunch of freaking idiots is what we have in all these US consulates.

    asindu...sorry to hear that man...can you post the link of this act or an analysis of it. I bet a lot of people will support it if they see a credible evidence that it will help the legal immigrant community. There seems to be a widespread belief that this focuses on the illegal community.

    There is a lot of bad rap that we the legal immigrants have to face because of the rampant illegal immigrant problem, most of the folks here gets peeved off if an act has a bias towards that.

    I've been a consultant for 5 years now, worked for 5 different clients, and was without work for just 4 days so far. If consulting companies are banned, it means that I will steal the job of one of you permanent employees.

    People do hire me as a contractor and pay me big bucks for a reason. The only way I can choose what I want to do when I am still on H1b, is to work for a consulting company.

    I know a lot of mediocre people, afraid of not being able to find the next contract, end up in a boring permanent job. May be they like it too.

    Don't get offended. You need to see the other angles too. I showed you one.

    Does this mean that you cannot have 6-9 years extension of H1B for the new employer and you must use the EAD after six years if you are changing jobs?

    There are more risks in using AC21 before 140 approval.

    Read the Aytes memo of Dec 2005 regarding portability before 140 approval. There is all kinds of things that can go wrong if you port off to a new employer before 140 approval.

    Other than employer withdrawing 140, the other issues are that if there is an RFE on your 140 and you have already used portability and ported off to new employer using EAD, then what would you do if that 140 doesnt get approved. Because if your H1 6 years have been used up, you are on EAD status, and your underlying 140 tied to 485 doesnt get approved, then it means you are out of status and you are out of luck. You cant even stay here to appeal the whole thing, you have to pack up and go back.

    If your COS application was approved and you didnt have to go out of US for H1B stamping I would assume your are in status.

    I dont know if this would come up in RFE or at interview stage, but I wont worry about it unless the period was more than 180 days.
    Thanks for the responses. How about this question ?
    Is it out of status if one gets paid from 2 companies with
    2 H1bs , like, If one is on bench but getting paid by that company, starts working with 2nd company on transferred H1b, so it is like double pay for about 2-3 weeks .

    My 485 application was received by USCIS at Nebraska Center on July 06, 2007 per the tracking receipt. My attorney received the receipts intrestingly from California service Center with receipt date July 06, 2007. I received a transfer notice from California Service Center dated Sept 12, 2007, with receipt date as Sept 04, 2007. Also the check was cashed on Sept 06, 2007.
    Should I worry about the receipt date on the transfer notice?
    Would this delay my processing of 485?
    Please advice.

    Sometimes a rule/law might be an unpopular one, but the right one. All popular ones does not mean they are correct. People who have the guts to make unpopular / but the right decisions and enact them are the real leaders. This time, either this year or next year, we will know if CIR is driven by real Leader's or Politician who exploit any situation to increase their chances to stay longer in power.
    Also do not see much media attention to anything related to CIR. May be it an election year politics that drive things now !!!
    If this law suit translates into some action to address this broken immigration system, then it is a good one !!! Will have to wait and see ....

    All officials and news coverage has talked about processing 60k visas in a month to avoid visas going waste. None clarifed to say the unused visas expire on 09/30 NOT 06/30.

    you think it is safer to submit the last 2/3 paystubs while on H1 earlier along with the other documents we submit while filing for H1, or not even submit them.. I know the officer is at full liberty to ask whatever document he fancies at that moment and my stars at that time..

    Do you think they will ask for the W2's while on H1 period..?

    I would follow the advise of your immigration attorney on this one. Sometimes they ask for pay stubs, sometimes they do not. So I would follow what your attorney advises on you. Normally USCIS will not ask for W2's. However an embassy will, when you go for stamping. They will ask for W2 and your tax returns to verify if you got paid whatever is written on your application as your salary.

    Right now with the unemployment at > 10%, immigration reform is a tough sell.

    For the average joe, an immigrant is a job stealer; despite the evidence that immigration creates new jobs.

    So I wouldn't pin my hopes on any immigration reforms, until the unemployment is below 7% or so.

    If this is true, how come CIR is one of the main agendas of democratic party. Also remember hispanic votes were a deciding factor in the last election. GOP acknowledges that. Moreover voters demographics has changed since last election. Electorate is comprised of higher percentage of forward thinking younger generation.

    IMO anti-immigrant racist voter percentage will be on decline in coming years. So democrats/gop is better off catering to the likes of this younger generation.

    Yes. misrepresentation is risky and dangerous and no one is asking you to do it. All I am saying is don't submit information that weren't asked and expose yourself. For example if you only need to w2s for 2006 and 2007, don't submit 2004 w2s when you were paid less etc. IOs make the decision with the information provided to them and issue RFE only if the info is not sufficient or require clarification. In fact this is what even UnitedNations wrote in other forms.. i.e. don't pro-actively submit extra documentation.

    Coming to my wifes case, apparently, according to company records she was their employee since the start of H1B approval, but they were reluctant to put her on project and payroll with out SSN. When we mentioned this, the company owner was very cooperative and in fact ready to give us any letter we ask in case of an RFE or any time we request.

    Btw, do you honestly think I (or my attorney/assistent who filled the entire application for us based on the documents 'he asked us to provide' - We just signed it) don't know what you were saying about mis-representation?? Remember, I didn't even know there may be problems with her 485 till I posted on this forum so no question of any deliberate mis-representation. Since our attorney asked for copy of every document 'specifically' as a bulleted list separately for both of us, we assumed that he would point out issues if there were any. :).

    Also, this is exactly what I was saying.. why do come and visit this form, go back and pull my first post and quote on it?? :). If you have a suggestion or solution, please do offer.

    Anyways.. Wish you all the best. I hope your wait would be over soon.

    Most status related issues are wiped off after a travel outside US.

    What I would worry about most is if any misrepresentation was made to USCIS as far as status goes. Years later or even during naturalization, one's could face audit and possible revocation of an approved application.
