Hi folks,
Need some help.
During e-filing of AP, certify page has a TITLE field. Any ideas what needs to be filled in it ?
I am filing I-131 for myself and spouse.

Sorry to hear about your situation. You should've taken unpaid leave for two weeks instead of a lay off. Now you definitely should not file AC21 and hope that the USCIS will not issue RFE (rarely happens). It doesn't matter how you quit, if the USCIS finds about it, it will probably deny I-485.
Regarding Shusterman's Q&A. I am not sure where is he coming from. The law does not provide for lay-off exception.
Recently I heard that if you are laid off from the company, then the 180 days period won't come into picutre and you can very well move to another company, provided your I-140 is approved and not revoked. I think they have made some modifications recently to the law on this type of cases. Talk to your Lawer to find out these changes.

After this it will have another round of hearing on June 23rd . Which is Full Commitee. Which will makr up bill and if passes there it will send to clerk for scheduling to debate on house floor.
Before it reaches to house we need to make sure we call CHC members and other lawmakers to educate them before bill on floor.

I filed for my self, wife and two daughters I-485 and EAD with all documents but without I-140 recipt notice instead I enclosed evidences of the cashed check, INS online status print out and cover letter with reciept number.
My application reached on July 2 at 11:34am. No reciept yet. I called INS and representative explained my case will not be denied. If at all, INS will ask for the reciept notice.
I have my reciept notice for I-140 now.
At this point shall I wait or apply one more today with the reciept notice.

I think for few people this might be bad news. Some people changed their job without I-140 being approved. Sorry guys...i used AC21 but i have approved I-140.

I believe pre adjudicated means, most of the processing is done, and waiting for the visa number availability.
Nothing will happen for you on the info pass, hopefully you will come back with a good news.

Immigration has to happen this year.. else it will have to wait for ever..
there are no elections scheduled this year or late into next year.
To link unemployment with illegal immigration is a far stretch...
a.) what is the proof that illegals here are not already employed?
b.) Do illegals and citizens/legals compete for the same job? --> probably Not
It only means these faceless humans will get some rights and protection...
illegal immigration is one of the main source of flesh trade from eastern europe and latin america....
BUT the socio-economic impact this will have on US as a whole is a whole new topic...
If this is true, how come CIR is one of the main agendas of democratic party. Also remember hispanic votes were a deciding factor in the last election. GOP acknowledges that. Moreover voters demographics has changed since last election. Electorate is comprised of higher percentage of forward thinking younger generation.
IMO anti-immigrant racist voter percentage will be on decline in coming years. So democrats/gop is better off catering to the likes of this younger generation.

My PD is years after you folks.. just wanted to wish you good luck!
Calling all EB3 INDIA applicants with a PD before October 1, 2001.
Friends we have been current since November 1st of this year. Many of us still have not heard anything about our cases. If you have this PD you have already been waiting over 7 yrs. What should we do to get USCIS's attention to look at our cases. It seems service requests are useless. They send the same old letter to everyone and thesere is no action. Whats our best options. Lets gather and look at ideas on what we can do. We know USCIS is so random.
Friends this is very imp for us. We have already suffered the most and are the most behind in dates compared to any other Category and country. We waited in pain and silence for years for our PD to become current. Now it finally is but still we see no action. Guys speak up lets try to do all we can. In this economy last thing we need is a waste of our 7 yrs of waiting and our files falling through some crack because of a random USCIS process.
Any thoughts, ideas ? whats worked for others and whats not. Will we get our green cards while we are still alive ????????

Hi Guys,
After a long journey of more than Sixteen years in this country, I finally received my GC.
In short, I came in 1993 on J-1 for my training which took six years, followed by one year on O-1 visa and then J-1 waiver for three and half years in underserved area. Then applied for labor certification in Oct, 2003 EB2, through university, which was approved and then retrogressed. Applied Schedule IIA, approved but also got retrogressed. Got AILA liaison and Senetor involved.
Applied for EB1 and NIW in July 2008.
My lawyer was very much involved in the whole process, was very helpful at every step, and wrote letters to USCIS.
Finally, GC came in April, 2009 and received the cards one week later. My PD Oct 2003.
During these time, I actually had no problmes at my job or my my wife's job. Brought a house four years ago.
The main problems were:
Daughter and son could not apply to state colleges/ medical colleges. (daughter going to med school next month)
Got stuck in India for renew of H-1 for 2 months!!! (worst time of my life, with my wife and kids in US) I tied every thing from writing letters to calling Ambasador. Not effective.
Could not go to certain occasions, like death of very close family members, weddings etc.
However, I kept my cool and prayed and got lot of support from Immigration voice.
As a small token of appreciation, I am donating $500 .(and will keep on supporting)
We all are going to get GC, some sooner some later. Just keep on doing you job.

How about if IV publishes his brief story( off course with his permission), congratulating him on IV behalf, in all national news paper ( with or w.o his name ) Date of entry, profession, long time wait- reasons and all opportunities he may have missed, couldn't buy house, collage-tution probelms etc and all struggles he has his family might have faced. point by point.
Money would come from special campaign. NY TIMES, USA TODAY, Chicago Tribune, Washington Post, Miami Herald etc. News paper industry is struggling so won't cost much to buy a half/quarter page with a title - " An untold story of legal immigration" Or similar kind of eye catching title. Not more than 10-12 lines stating thousands others are waiting in line...
There won't be difficult to get more his kind of cases to run it on regular basis in future.

One important issue is over looked here. Small employers will have a tough time in proving I-140 "ability to pay" for employees with older PD�s, whose labor got cleared after Aug 17 from BEC. Cuz the company has to prove its "ability to pay" the proffered wage starting from the date PD is established continuing until the adjudication of I-140.
Suppose the PD for an employee is Oct 2001 and the proffered wage is 80K per annum, then the company should prove that its assets, net income or salary payments were >=80K starting from Oct2001 continuing until the adjudication of I-140.
This is indeed an acid test for small employers.

Guys as someone else has posted earlier, there is NO basis for asking for this.
CP was created for getting your GC if you are OUTSIDE the US. It is now being conveniently used by people within the US to circumvent certain issues and to get the process approved earlier. EAD and AP are for people WITHIN the US.
So please talk to a lawyer about finding out how to convert a CP to an AOS and you can apply for your EAD and AP. IV cannot keep adding to the list of things to ask for. This point has been stated by the core members over and over again. Currently you cannot have it both ways ie get ur GC quicker through CP AND in the meantime enjoy the interim benefits of the EAD/AP.
Whether you have contributed or not is besides the point. The contribution is to speed up the GC process not for what each individual or smaller set of individuals want for their custom needs.
BOTTOM LINES:
1) IV is fighting for the ENTIRE GC process to be faster.
2) IV Cannot keep changing its goals and what it stands for.
Sorry if this sounds harsh, but that is the way things are and have always been.
