    I am not saying Thanks and Good bye, As you see even after my GC I am still responding to your message. I am fully supporting the VI initiative. but the problem is that USCIS will do only what they think it is right and not what is really right. Me being in the Q for so long , I will never forget the Horrors of waiting for GC, even after getting the GC.

    We as indians are divided lots in every area, we are like CRABS. certainly I am not one of those CRABS, My friends will give a ample proof about that.

    In matter of fact, As a community, we are not PROUD about OURSELVES and our HINDU CULTURE, we cannot make any DHARMIC efforts to come under ONE UMBRELLA and fight for our cause. IV is one initiative, which is good but not enough, because do we get any help from our Indian Embassy or any Indian Organisation in America to support us, NEVER. this is because we DONOT LOOK UPTO OUR INNER VOICE AS HINDUS. I am not saying this to you in particular, I am referencing this as an INDIAN COMMUNITY. SO PLEASE NOTHING PERSONAL.

    every one of us is a GOOD PRACTISING HINDU BECAUSE WE LIVE LIFE WITH OUR DHARMIC VALUES AND PRINCIPLES. IT IS TIME TO COME TOGATHER AND IMPLEMENT THOSE VALUES AS A HINDU SOCIETY.

    -- Is there any real example on any internet forum, website or blog where someone faced problem in citizenship because they left their sponsor employer before 6 months expired? Do not find opinion but a real proof.

    -- Can any lawyer provide a case example to illustrate the above. We can go into detail, talk to USCIS and seek clarification.

    -- Is there anywhere in the law, memo or rulebook that says 6 month employment is needed after getting green card.

    So stop giving advice like these and focus on extinguishing the fire.

    I was not giving advice. I was clearly requesting "Please guys, let's not fight" and trying to divert the conversation to a logical discussion about horizontal spillover helping I & C. My conversation with him did end in a civil manner.

    In the mean time a random passer by like yourselves comes along and stirs the pot again, when the fire was just about to be extinguished.     Nah Man. No FP yet. I called USCIS last week and customer service said they have sent some notice and she was not sure about the type of the notice. I will wait till this Friday and will try to contact USCIS again on Monday. Will keep you posted. Also I didn't file DHS 7001.

    Any update on your FP notices yet? am still waiting. Did any one of you file DHS 7001 for ombudsman inquiry?

    I was on bench for about 4-5 months in 2004, so didn't get paid. Will it pose any problem?

    Well, I have been with the same Employer all along since my date of entry, and the only problem is my W-2 amount for 2004 is kind of 50% of my offer amount.

    Same in case of 2003 also. But my last date of entry is 2004, so I am thinking I NEED NOT worry about 2003, just worry about 2004.

    I really apreciate it, if someone clarifies the implications.

    There is a very good chance that something will happen soon if we rush. if you are smart enough to think that filing on july 1st will guarantee your acceptance, then you are wrong buddy. As per the other threads and discussions from lawers , immigration officers, and info pass applicants that we have seen so far, uscis can change and will probably change the rules of accepting the application if the demand and rush continues. Already we are seeeing 45 days backlog of receipt.

    besides lawyers just have to instruct fedex to pickup and deliver it on july 30th, how difficult can it be ?? except they should have little more room to pile up the applications until july 30th :)

    Don't spread rumors! You should know better that people are worried about mid-month retrogression rumor and you are icing that with your silly conclusions from people like you. Not only you are not helping anyone with this thread but you are creating unwanted headache for them. Please stop and wait for your approval, since you have already filed. Do not worry about all of us!

    If something is going to happen, like you say, let it happen. There is nothing we can do to stop that and in worst case we won't be albe to file 485. We would still be very happy for you that you had filed and got your GC. Be happy but please stop this nonsense.

    As I have already accepted that my decision of choosing CP was not right during the time of recession. When dates became current, I thought mine will be current in a month or so and CP is a faster process to get green card as 485 filers some time stuck in name chack and all ( as I know couple of friends). So that was the only reason I filed Cp instead of 485.

    There is one ideom in Hindi -" Chaube jee chale chhabbe jee banane aur reh gaye dubey jee"
    So I am dube jee now.:rolleyes:

    Bhai, Please read his previous post. He admit the thing. No need of a witness. He himself wrote in IV.
    misdemeanor charge and green card

    I may be charged with Misdemenor Class A for Domestic Battery around 15th of Nov/1st week of december(Court Dates).
    Am I screwed for green card? I applied for 485 in July, got EAD.

    Will there be a Deportation process involved? I am prepared for the Worst hpoing for the Best...

    This is my first offense.. I have not had any offence at all...

    Will being on Probation cause a issue. I spoke to my Immigration lawyer.. he said I will be called for a Interview...
    He asked me to tell the Criminal Lawyer to try to get supervision. but he said not to plead guilty...

    When I relayed the same to my Crim lawyer,, he said it will be difficult to get Supervision if we plead not guilty...

    So does it mean Misdemeanor does not qualify for Deportation?

    I am cofused whether to plead guilty or not...



    Were you witness to what happened in his home on that day?? If not, don't be judgemental....leave that to him and his wife and to family court. IV is not for "every good cause"...we are having very difficult time ourself...

    Looks like you already received GC and you have great & lot of time to get into other issue.

    Well, they could be talking about a subset of the annual quota, such as the quarterly quota. From the context, I don't think that is the case, but I'm also not used to seeing the State Department flat out admit illegality, either.

    Well, if they do broke the law, can we do something about it? Like class action law suite???

    this could be read 2 ways...either you need have an approved I-140 prior to filing for portability OR the adjudicator needs to approve the I-140 prior to determining portability.

    You can read it 10 ways, but the CIS has only one interpretation(see bold below).

    An un-adjudicated Form I-140 petition is not made valid merely through the act of filing the petition with USCIS or through the passage of 180 days. Rather, the petition must have been filed on behalf of an alien who was entitled to the employment-based classification at the time that the petition was filed, and therefore must be approved prior to a favorable determination of a �106(c) AC21 portability request.

    What were the PD's on your two I140's ? Were you able to port the PD of EB3 to EB2 ?
    Both were EB2 from the same company. PD on one was Oct/2006 and the other was Feb/2002.

    I don't think PMP is useful in promotions......it may be helpful in getting a new job though.....but then you are limited in your career..........PMP doesn't help you moving upwards.....!

    Not to be pessimist but I tend to agree with learning01 that Nothing is going to happen. This is election year and it will be difficult to get such sweeping and comprehensive legislation passed. Having said all this, I will continue to support IV as I think these efforts will eventually pay off.

    learning01, I laud your efforts. However, I am not sure what incentive any employer has to really help with this cause. Sure worth trying though.



    Newt said Nothing is going to happen on this Specter or any other immigration bills in Senate. The conference with House will not agree to anything.

    I also sincerely believe that Nothing is going to happen I say, these senators are doing CYAs; they will bitch it to media, their constituents, hey look, we did attempt these immigration reforms.

    I am talking from my long experience and wisdom and take it from me. The only force that can improve the pitiable conditions of Indian and Chinese due to retrogression and lack of visa numbers is the big corporate employers . Each one whose LC is approved, whose I-140 is approved, who is waiting to file for adjustment of status AND who are indispensable to the employer / work at this stage should write to the HR/ Immigration/ Attorney.

    I am in such a position. I am a technical lead in my IT department. PD Nov 2001. I write about these issues and the difficulties once in a month my team manager, or project manager or Immigration department.
