Need suggestion how to proceed with my new approved I140.
I have two approved LC.
1. PD EB3 SEP 2003 for which my I140 was approved and I have applied 485 during July 2007.
2. PD EB3 MAR 2002 I got my I140 approval yesterday.
All for same company.
Is it possible for me use my new I140 for my 485 which I have I filled already? I have requested my company’s attorney to find options.

Here is my scenario:
My first H1 was approved in 2004. But i came here in June 2005. Will my 6 year count starts from June '05 OR Oct '04 ? Pls suggest.

Hi, we have approved EAD and I 485 Pending.When called to find about the case they send the leter which says---
The status of the service request is: ur case is on holf becoz u appear 2 b inadmissible under the current law.Rather than denying ur application based on inadmissibilty,we r placing ur case on hold while the dept of homeland sec considers additional xcercise of the Sec of Homeland security's discretionary xemption authority.Such an xcercise of xemption might allow us to approve ur case"........................PLS ADVICE .What happend to ur case?What did ur lawyer advice.I have taken an appt. wt my lawyer but he is out of town and seems it will take sometime...

What I don't understand is it's not mandatory to inform the USCIS about moving to a different job via AC-21. If you are not required to inform them, then where does the question of AC-21 approval arise ?

This does raise some valid questions... For instance, what about children from, say, a previous marriage? What about children when the couples are not married? Do the children qualify under FB visa?
I realize this has nothing to do with EB immigration, and that such cases are relatively uncommon. But still, if someone with expertise and experience can comment, it would add to the knowledge base, and who knows, someone might find it extremely useful.

My GC application is buried somewhere, had a vey bad week at work with piling up workload and closing on deadlines, my child as a cold, my neighbor's dog has an infection that shows up smelling foul in my front porch, it is going to snow and rain this weekend, May visa bulletin is released, EB-2 India has not moved up; topping all these there are some nimcompoohs here fighting out in a public forum about how incapable we all are to change the federal laws! God, have some mercy. Give some time to IV moderators and me some power to permanently ban these people to write to any immigration forums I read. At least give me my GC soon so I don't visit IV as often I do now and come across these kinds.

According to my spouse, there were three treatments at the embassy:
Passports retained for approvable/approved cases
Passports returned for rejected cases
Passports retained (no options provided to applicants) for audit cases
In your case, evidently they gave you an option as to whether you wanted to go with the delay. Am I right in assuming that?
Or were you asked to wait with your passport till they cleared up your case at their end?
We are not withdrawing our H1B application that was approved by USCIS. We are merely contemplating withdrawing from getting the actual visa stamp because of the uncertainty.
Right now, the embassy people are not being communicative at all. They did not respond to the last email we sent them and they do not have a live person taking any phone calls.
Initially they said the audit could take 4 weeks but their website (login enabled) says it might take up to 8 weeks.
The officer only said "you will hear from us when we get the clearance."
Said nothing about keeping the passport.

No. The way I understand it, the new employer is offering you a permanent job in the same/similar job classification. So you work for the new employer in a permanent capacity after you receive the green card.
I have a question....Green card is for future employment.In that case,once your I-485 got approved ,you need to go and work for your original employer who sponsered your green card. Is that right? Is that the same case if someone uses AC21?

My lawyer is asking 350 for EAD and 500 for AP for each person excluding filing fees.Is it normal.or Can I go to another lawyer for EAD and AP who is cheaper than my company lawyer.
Thats a lot of money for EAD & AP. The law firm might be charging 2 grand for your 485 and another grand for your spouse's 485. You dont need a lawyer for filing EAD & AP. You can file them youself along with the 485 application or after getting a receipt number from USCIS for your 485 application. Ask your law firm to prepare 485 for you and your spouse and return the application packet to you. You can sign it off, add your EAD & AP applications and send it to NSC. I supsect they would be willing to do so. By not giving them they would be forcing you to file EAD & AP through them, given that the fees for everything is going up from next month.

Another point I think is that even if IV had a couple of million dollars I don't think it will be able to pursuade the Congress to pass any legislation to bring relief to legal immigrants considering the mood of the people in the Congress . No one would like to hurt their political career with voting for us in the Congress. The politicians do only lip service whether for illegal or legal immigrant bills. They have zero interest in seeing them passed in the Congress.
Well thought I had to answer this better. The answer is YES, we can get bills introduced and passed if we had 2 million dollars. Lets not make assumptions about what congress cares for, we'll let core members handle that. As written previously, we have managed to get quite a lot of change done with minuscule funding, even though we haven't been able to afford the best people.
Maybe right now even achieved a bit more than the illegal immigration lobby.
How exactly do we do it? - Check Donor forum, where we get constant updates on our efforts in Washington DC.
Donations start at a one time of $25, even if that's the only thing you do all year.
There are some thinking why not get everything for free, when IV is already working? Its a tendency of many to save as much as possible, and get the thrill of getting something free. As I speak, Donors are benefiting from IVs efforts. United we can achieve a lot, Divided we fail.
The other common excuse is - "I really don't care, even if I don't get the GC, I can always find a job back home. Pay $1000 for my return flight. Just visiting... "
Well I guess the other option of spending much less, getting a GC in 1-2 years, starting your own business in the USA, making much more money is really something no one wants.

Yeah if the restriction was for non immigrants none of their "special" buddies from gulf states like UAE, Saudi, Kuwait etc would be able to visit.
Many of those " special buddies" would have diplomatic passports, hence no inspection at the POE
But i think you can not practice polygamy or bring multiple spouse to the US on non immigrant visa

I am still waiting for FP, i created SR, hey told i have to wait for 4-6 weeks, which is already over.
I took infopass, my name check is clear, No info abt the FP Notice.
Any one in same situation transfered cases from NSC-->CSC-->NSC not yet received FP yet.
