    Your logic is beyond me. On one hand you seem to disagree with the practice of labor substitution but on the other hand you are more than happy to provide the recipe for it. Are you for it or against it. Or may be you are just trying to help an IV member.

    It may be legal but should be discouraged to say the least.


    Other than that, you will find a lot of hatred from this forum as what you are doing is very much inflaming since you are cutting in line -- legally so -- but still, its cutting in line. So dont be surprised by that.

    Sometimes in your life you make bad decisions. It happened unfortunately, because my PD is June 2004 EB2 and when dates became current last year, I thought it needs to move just 3 months to have my date current and as per DOS release there were only 3400 visas in EB2 for 2004.
    Unluckily I chose for CP instead of 485 and now lying in a dark well.

    Anyway please don't sympathize, I'll certainly come out of this situation very soon.

    Pls check with your lawyer if you can change to AOS from CP... Then you'll be entitled for all the AOS benefits.. I know few of my friends did filed for CP instead of AOS and maintained their H1/H4 status... So no choice is good or bad.. it keeps changing :-)

    Since AOS can convert to CP.. I think it should be possible otherway too...

    Is it really against EEOC guidelines to specify US nationals or GC holders for jobs which do not require security clearance? I mean that specification is so common to job advertisements that I always assumed the law allowed that.. certainly news for me if that is not the case!

    Definitely nobody would have thought giving Green Cards to Legal Immigrants who are making renting industry thrive can also solve US Housing Slump.

    Next time, they may even see a possibility if giving Green Cards can also solve Global Warming!!!!

    You know actually it can happen with majority of desis driving green vehicles (honda/toyota).
    it is not wishful thinking ..dumbo ..it is a good idea but it doesnt / wont have much support as community is divided and happy with its ead.

    I always wonder and think what we do more that cannot be done offshore in India. As a business owner you are always concerned about bottomline. I work for IBM and I am on short assignments at different client locations, during early 2000s some offices used to have exclusive american staff (or should say white) then it was Indians on H1 Bs and now there are more Indians in offices than americans and if I check who they are, 90% of the time they are on site from a outsourcing companies. So I see that as a trend. As a CIO you got to wonder if I employ 90 out 100 of my staff who are high skilled Indians here why cant I just go to India and get them for cheap and tell my fellow CIO buddies how I saved money and how they should also do it. So it is a combination of cost benefits and chain reaction.

    Even I feel what I can I do which my fellow Indian in India cant do, since considering we went to same school etc. It is not like we are inventing rockets here we are all intelligent people to some degree and hard work is part of our blood so if I can do it I bet my neighbor can also do it.I think it not far when everything repeatable will be moved to India same as why you do not find very many americans laying a optic wire cable or digging a road, but almost 100% of the time the optic fibre company boss is American and usually white.

    I understand CIO line of thinking ...he may see all indians around and think of offshoring ..but he dont realize the desi consultants are here through a preferred vendor who might be american who is getting business through this placement and he might be employing one american and so the chain goes on ....But when he says to CIOs and every one start doing the same ..then after some time the Job growth decreases, so is consumer spending ...And as a result ,this CIO may be layed off ,as a part of cost cutting measures and Outsource his job too ...:D

    At the same time i dont know enough to take any side between free trade and protectionism....

    My situation,

    I am a july 2 filer, planning to use EAD to work in diifferent company in same profession(NOT invoking AC21). On I-485 approval want to come back to the original employer who filed I-485. my company is supporting and willing to support for any RFEs.

    Please tell me if it is going to work and what are the risks involved.

    Thats true..everybody are bothered about EAD and FP. I am here for more than 8 years in this country. IV should emphasise this and USICS should allow affected candidates like us to file I-485 and atleast get EAD. we have priority date earlier compared to others.

    well you guys are the kings of jumping ahead of the line using labor substitution...how can any of us be knowledgable on the subject...contact unitednations or ppl like him who "help" the skirters of the law.

    svan77: if a person posts on a forum he or she will get the opinions of members whether he/she likes it or not. all of us have our beef with labor substitors and ppl with 3 yr degrees or aptec/niit diplomas who just believe in jumping ahead of the line and have no qualms about it.


    Well said yabadaba , the fact is that Desi Consulting companies have used labour sub as a carot for so long , some to the extent of selling it.And there were people who were always interested too.Many of them were not confident of clearing labour on their own credentials ( BSC Zoology, BBA, BCOM etc..) or probably wanted to jump the line.
    A mistake on USCIS part too , why they allowed this malpractice for so long , even now when they have stopped it , quite a damage is already done.

    All,

    With the current rate of outsourcing happening around in US and the rate of influx of temporary workers coming in on mostly L1 and may be few on H1 B Visas every year through the outsourcing companies , i am sceptical about the future of GC aspirants. With the way of GC processing happening which are caused by restrictions /policies of governing bodies and no sight of positive relief in near future i am little apprehensive about the future.

    I feel that there might be no areas that are not impacted by Outsourcing boom . Most of the companies that i see and my friends work ,i see many of the operations are outsourced or planning in place to get outsourced.

    with the current rate of outsourcing and subprime mess which may cause slow down in economy , i am not sure if there would be any positions to support our AOS , when our PD becomes current. Some times i think , the fight for GC is even worth it.

    Every one feel free to post your views/opinions/Analysis on this topic ....

    The impact of outsourcing (if any) would only be on lower level software/IT jobs which are getting sent to cheaper destinations. However the GC applicant pool is much wider than just IT/software programmers, so overall the impact would be smaller.

    MIRAGE!!! thats a hell of surprise that your friend contractor actually spend money to sponsor H1 and also the airfare!!! amazing. Pls take a little time to visit the murthy website, which apparently now has become a place for all the desperate people to cry. There are many reported and believe me inumerable non-reported cases where the candidate themselves pay for the H1b, which is completely ilegal in the first place, OK. Now your friends brother jumped simply because he was paid below the prevailing market rate and he was better qualified. So many of those who come here through contractors are not very qualified. Anyway nothing is going to help with we arguing against each other, right? lets hope the CIR prevails and the visa system is better regulated regarding (qualifications, advertisements, pay scale, benefits etc).

    My PD is Nov 2004.
    I do not have any dreams of my 485 being cleared this month as my I140 is pending at TSC since April 2007. Just last week we got an RFE and the attroney is working on the response.

    everyone I go to offers Digital Photos (ID PHotos)....my attorneys had said Digitals are not acceptable...but looks like that is all u can get nowadays...
    BTW Costco is the cheapest!!!

    please be more precise. when you transfered and when did you file your 485 with company A or B.

    I TRansfered my H1 B Visa first time in the August 2006 from Company A (GC Sponsering Company) to Company B.

    Everything went good.

    Last year in March i did transfered my H 1 B to Compnay C from Compnay B

    and i July last year i applied for my I 485, and got my EAD in Sep 2007.

    Now the total 180 days have been passed am i eligible for AC21 and if yes then what are the formalities to get AC21.

    Also Compnay A has told me earlier that they will revoke my I 140 but i do not have any means to know wether they did revoke or not, how do i know if they revoked my I 140 is there any way to find this out.

    Your Help Will be a big Help for me
