what should we ask them for if we call, 'coz they might not have entered our file in their system yet.
Is it possible to ask them if they have the file with them and ask them to do a name check on the applications or some kind of relevant information related to the application. i am sure they should have put the files some where with some easy to identify tags. can some one call the uscis, i am planning to do with the nexy 40 min as that is when it is 8 here in the pacific coast :-)

The employer didn't provide him any papers for labor cert but somehow he got hold of his I-140 notice approval. He changed his job now and filed eb2 with new employer. I see no reason why he should not do interfile.

I have seen people in my organization coming from ROW countries and getting complete GC in less than 15 months. You should really get frustrated with country quota, not with your fellow sufferers.

This is not just contained in the US. Yes sub prime mortgage mess was concentrated in the US. credit crunch is affecting globally. This is unprecedented in recent years. Analyst opinions can be thrown out the window. There is big psychology to play. Are you willing to trust where u have ur money or not.? Thats the bottomline question at all levels...banks, bonds, stocks, commodities, options..country reserves etc.
Fed & treasury (also other similar global regulators - I know of Russia & India) are also pumping money into the system to prevent a total meltdown.
Liquifying of assets will happen sooner rather than later. Cash is King, Queen, Rook, ...pawn etc. But what is this cash? is this currency note that is getting devalued by the minute (global currency devaluation is going on). Or is this some commodity like Gold, oil? Whats gonna happen to gold prices? Oil prices are down in the condition that people consume less....global recession. Confidence in the fundamental economic system needs to happen for things to pick up. IMO that will happen only when the whole system is purged of such unregulated manipulation of paper money. Its gonna be back to basics - macro economic lesson for the whole world. price = where supply & demand curve meet.
As long as other global economies that rely & be dependent on the US economy still have faith in the US treasury...it may still be ok...but who knows when China is gonna start dumping US investments & adding gold to their reserves at a faster pace...at that time...more bets are off.
Another specific comment about someone mentioning socializing loss....to an extent thats true...but it wasnt like the majority of the US people didnt contribute to this mess...they did when they kept borrowing unending into the paper equity of their home value. Everest Consulting Group Inc is really good. I know them personally for more than 10 years now & they do what they say and do NOT torture their employees like many other consulting firms. I just got my GC thru them :)

Correct me if I am wrong, but you've had unexpired H1B while you were out of work. This is not considered unlawful presence. On top of that, violation of status determination can be done only by the USCIS (IO). If they did not inform you that you violated status, you are good to go.

You got couple of things wrong here. Passing a legislation is not a piece
of cake. It would take sometimes years persistent effort. Contributing
a few hundred or even a thousand dollars and expecting everything to be
changed would be too ridiculous. Several tech lobbies are also lobbying
hard for similar things. And they spend money in millions. Any man with commonsense could understand how difficult things if those powerful business could not take care this.
Now u may ask, if these tech lobbies cannot take care of it how could a small group like us do it? Last year when CIR was passed in the senate, there was a catch int. It would have imposed hard country quota. With IVs work we were able to remove that hard cap clause from the bill. The bottom line is that we may not be able to pass a huge bill, but we could get sevearl smaller bills in peacemeals that would help our cause.
If we keep on working on it, eventually some doors will open for us. But nobody is not sure when thats going to happen. So here is my take on this whole drama. I'll support IV for next 3 years. And if nothing happens I'll pack my bags. :D :D :D

I think we should -
1) Wait till this session of the Congress gets over.
2) Form a work group that will chalk out the plan (of efforts).
3) Execute the planned efforts.
Efforts could include things like -
1) Discussing the proposal with supporting Senators like Zoe Lofgren.
2) Making conscious efforts to publicize our woes and genuine issues / conditions.
3) Quantify the benefits of our presence - in evidence of a quantified evidence, idiots like Loo Dog, etc. can't refute that much.
4) Talk to organizations like Lazaras (or some org.) form a more cosmopolitan group including Chinese and others as well.
5) Letter campaign in mass to all Congressmen's offices telling them the sad story about waiting for 8-10 years.
6) Any other efforts that CORE comes up with.
Planned & focused efforts always yield desired results... I believe so.

EB2 dates may be unavailable/ dont move. But it is just for a very short span of time. And after that EB2 dates start moving quickly again. I presume by 2009 october, the EB2 India PD will close to 2008. Any retrogression, if there is, in EB2 will be very mild from now on because of the spillovers.
Regarding EB3: Every year there had been about 100k approvals in EB3 category, out of around 160K(even though there are 140k visas, there have been approving more because they are using unused family visa numbers) approvals in Employment Based Category. This is because of vertical fall outs of visa numbers. Now they have changed the scenario to horizontal fall outs (spreading across at the same category level( ex. EB2) irrespective of country of chargeability.). So this time it would be around 100K approvals in EB2 category.
Let us make as much noice as we could because of EB3 retrogression. That doesnt effect EB2 movement. But may make it possible visa numbers increase for EB category by legislation. So we have to support this agitation made by our EB3 friends.
I could seee all the EB3 folks with PD older than 2006 and EB2 folks with PD older than 2008 will be cleared off in the next two years. I am sure there wont be not more than 1 or 2 years delay between EB2 and EB3 categories in near future.And there are lot of things going to happen for employment based immigratin in the next two years.
This EB2 movement of 2 and half years is just a first step by DOS.

I joined the company only for green card, I was a consultant for them before I became full time. They told me this 'We will sponsor green card, will you become full time' I said if you do green card I will join. But they did not keep their promise. Thatis give and take. They already gained from their investment, Thats y they dont want to sponsor anymore. They do green card for what we do for 6 years not for sticking with them for 20+ years.
if I was in my company shoes , I would not take the documents, drag for 2.5 years and say 'We found candidates' . I would have either said in 6 months sorry we cant do or file green card.One need to have honesty. If I am that smart likemy employer I would ve started a company already and firing H1 guys left n right

Well, the fuss is not just about the wait - it about the seemingly interminable wait. Why should there be a wait of 5-6 years to get a green card, when you can get EAD in less than 3 months, or a visa to work in less than 2 weeks?
If the US govt. can decide that you have the qualifications to do a job (H1B premium), in 2 weeks flat, then why should a green card based on the same employment take 5-6 years?
Why should the wait for an Indian or Chinese be 5-6 years, but others be less than a year? At the moment, a cook from bangladesh is getting the GC before a doctor from India. Was this the intent of those who designed the EB "preference" system?
If you have infinite patience for GC, then that is good for you. But just waiting and scratching is not in my character, nor is it in 99% of fellow IVians.
