Because of sudden influx of projects coming to India last year, there was a temporary upsurge in the demand for skilled personnel in india ....So there are many options for these people which caused the higher attrition as they have many options open....So temporarily these IT Companies used to retain highly skilled employees at any cost and kept them in front line and recruited some freshers (i have seen one company recruited freshers and charged them 50,000 ...you heard it right :0 initally with the commitment of 2 years).
As the freshers are catching up with the experienced ..i see a sharp decline in demand my area of expertise from past 6 months to an Year .... But from CEO point of view , still work is done ..with 40 % or more saving ..may be for little compromise on quality ....
I have a feeling that attrition rate may slow down in coming years .....
Any one please share your views /experiences ..

INfy and Wipro can use L1 or B1. No need for new visa.
MSFT do not abuse h1b visa - they maintain their pay scales and follow all rules. When they say they want h1b visa quota available it basically means - they do not want to turn away a talented candidate because of lack of visa. All these companies are genuine in their usage. So they can definitely give a proper response.
Now for a company like INFY. WIPRO, etc.. - h1b, l1b etc.. is a part of their business modal. They need some visa to bring people in and out as it is a big part of their business. If they really were serious - they must have presented their case and also work with US govt for a different kind of visa that allows them to do their business by convincing the govts about trade etc...
Now comes the consulting companies. There are companies that genuinely bring people and rotate them at various clients for projects and people stick to them till green card. But due to sheer greed - some of these have abused the system - they have absolutely no sympathy for their acts of greed. The max they can do is threaten, usse small time lawyers, cancel pay, write letters to USCIS to cancel 140 etc... do you expect them to give a proper response to the Senators?

I still have not received mine yet. I am pretty sure that our FP generation has some problem due to some glitch in their system.

I am the primary applicant. I am planning to get married in next 1 year or so with a girl from India. If I get my GC then she will fall under family based which will take years for her to come here. I do not mind moving back if that happens.
Since I have valid H1 can I do something,
There is no reason for you to pull out your 485. Get your divorce expedited and get married quickly and you should be OK as EB3 India is not really moving forward unless there is a visa recapture or something like that.
Your spouse will of course lose her 485 and will have to start afresh. But I assume she already knows this and is OK with that.

It is true that by law employer is supposed to pay all the labor related costs. Not only that you are not supposed to be engaged in any way shape or form in this whole process.
Thanks for the info. But is it really true that by law employer is required to pay for labor ? I think it used to be that only h1b expenses are required to be paid by employer.
Also, most companies ask for agreements to repay them if we dont stay with them for few years for filing greencard . Is these agreements legal if they ask to repay labor fees ?

Guys,
Pls do not lose heart.
speaking for myself, i have tried to remain active, but suddenly got swamped with a huge work-load.
in this economy, performance is a matter of survival. Not to say that we should accept immigration to be a luxury.
It is a pity i had to miss the donor's telecon last week, simply as i was still working.
So bottom line: there are still people who are willing to participate and active, but it is a matter of immediate priorities.
Let us keep up the spirit and keep working....

With a record budget deficit, does Arizona really need to spend another dime on enforcement strategies that will do nothing to solve our immigration crisis?

Divorce in India takes a minimum 1 year to adjudicate if you were married less than 1 year. Otherwise, it is up to the discretion of the judge. Courts in India require a 'cooling period', with 'counseling / mediation'. Latter is basically a a sham.
That said, as a trained mediator, and negotiator, I would say ... a win-win outcome is always better for all parties. What happens to be 'win-win' is of course subjective.
Good luck in whatever you do! Trust me, things always work out well in the end.

This is not the case for me....but during a discussion with my attorney and other friends contacts they said if you do not attach the medicals now you may get RFE at a later stage...which you can resolve it.
I bet any RFE can be articulated with reason by attorney if they are smart enough.
This is something I heard...but do not hold me on that. Please check with your attorney too and make a decesion.
May not be enitrely true. Medical report is part of the initial evidence now, so its better to send it with 485 application instead of relying on RFE. Also your wife is already in home country, she can get all the shots required there. best option is for her to prepone her travel if possible. yet another option is for you to go ahead and file yours first and add her later. ^^This is not gonna happen... and even if it did....well I guess the companies will finally take notice when there are no new people to hire and fire and their bottom lines are hit with permanent hires for every small and odd project......guess what that they will do then....outsource more work to other countries......:)

India is India only... never compare it to US, and I do not think there is glamour attached to US green card, People who have the mind set of freedom and education and knowledge with a better quality of life still migrate to USA. There is no doubt about it India's economic grwoth comparing to US is really nothing. And never compare these two countries and never try to change the mind set of a whole generation, for business needs India have a unique culture, with lot of diversity. Still there is lot of poor familes (below the poverty line) in India, education has not reached the rural areas of India yet.
US economy is down and receission is meant to happen every 5 years in US some times to recover and job creation it takes longer if you read the US history and economics you will understand better. This time the open global media made it a big issue, that is about it. When the economy improves and things are better, again your so called glamour comes back. Glamour is in people's mind set, seeing movies and reading somebody else's writing. Still USA is far far better in living and social activities than in India.
