* As we advised earlier, the USCIS published a new rule that allows the USCIS to have more discredtion and control over the two issues: One is shortening of the timeframe for responses to RFE from previous 12 weeks to any period of time which they see fit. The second rule is their authority to either reject or deny petitions or applications without issuing RFE where "initial evidence" is missing in the filing. As we reported yesterday, attorneys asked the USCIS authorities to accept I-485 applications without the medical result, but their answer was that they were taking it under advicement but as it stands now, the sealed medical report would be required as initial evidence, accoring to the USCIS authorities who were present at the AILA Annual Conference in Orlando. We understand that in some areas, there are a huge backlog in the physician's clinics for such medical examination. However, people can shop around the authorized physicians in much broader areas. For instance, people usually were asked to schedule such medical examination in the local "district" office where the applicants resided. The definition of "district office" has been broaden lately. Former district offices have been turned into field offices of a district office. Accordingly, people can schedule the medical examination through a physician located outside of their residence if the area falls under the jurisdiction of "district" even if it is outside the jurisdiction of "field office."

If the US govt. can decide that you have the qualifications to do a job (H1B premium), in 2 weeks flat, then why should a green card based on the same employment take 5-6 years?
Why should the wait for an Indian or Chinese be 5-6 years, but others be less than a year? At the moment, a cook from bangladesh is getting the GC before a doctor from India. Was this the intent of those who designed the EB "preference" system?
If you have infinite patience for GC, then that is good for you. But just waiting and scratching is not in my character, nor is it in 99% of fellow IVians.

I strongly believe that Immigration Voice website should be paid website.
People should be willing to spend $20 per month for the information the website provides(foreg: It was useful for self filers to file I485 and saved atleast $2000 each person), I think $20 per month, should be enough for maintaining 99% reliable website and for its lobbying efforts and law suit etc.
Guys please share your thoughts.

if there is enough of a stink made over this, the law could be changed to get back the 'lost' numbers.... laws are there to cater to needs of the situation at hand anc can be changed. IV, AILA and the ombudsman are doing a great job in helping bring about a change in the law. even if congress decides to allow reclaiming of the numbers lost since 1992, there could be an end to this problem for the forseeable future until SKIL or another version of "the grand bargain" comes to the table.
I applied for 140/485 concurrently in August 2004 before IV existed. I can tell you first hand that IV has made a HUGE difference. Our voice is being heard above the din of mostly bigoted and ignorant comments by right wing radicals and liberals that only care about illegals/unskilled workers.
I am sick of the narrow minded comments of a lot of people that post here that only care about their particular scenario and dont take the bigger picture into account. We are all in this together and we will succeed only as a combined front and not as bickering individuals.

Thanks for your post. Is there any chance for any or Significant movement like this in EB-3. Now it's about time for EB-3 to move ahead. We have been trying for Bills every year, without any luck. Why is it so difficult for any movement in EB-3, which is stuck in 2001 and not moving ahead. It is really frustrating. EB-3 I is really suffering the most. Is there any solution for that ?

My online I485 status continues to be in "Initial Review" stage and the last date of change on my file was back in 2008.
Is there anything we can do to shake this up or just wait.

How abt showing the US govt - what is in it for them?
If they recapture x number of visas and y % buys a house soon after, it is a win-win situation. They provide solid ground under the feet of LEGALs and the benefactors build on top of that ground.
A key item will be to get a petition from a number of IVeans pledging to buy a house if they get a green card. If that number turns out high, this will be a good blil-board for our cause.

I feel frustrated at some peoples' unwillingness to admit that EB3 needs IV's help now more than ever. They are saying that nothing much can be done for EB3, as INS merely corrected its wrong interpretation in visa allocation
But, if we are all willing to put our hearts and minds to it we can surely come up with new ideas that will help our cause. Surely, laws are written so that justice can happen. So if justice is not happening, the law would have some answer, somewhere.
Let me put forward my idea.
The INA language says that until EB2 is not current, there will be no spillover to EB3. Agreed. But I would contend that this statement is on a year to year basis. That is, if in the year 2002 (for example) all EB2 has been satisfied, then the spillovers should go to year 2002 EB3.
Is this something IV can point out and fight for? Can EB3 members put their money and efforts in this direction? Let me know if this sounds worthwhile

I had a situation last year when I was flying Thai airlines to Bangkok from Phoenix. Thai airlines allows 70 LB per luggage and 2 luggage per person. However, since there is no Thai flight from Phoenix to Bangkok, I had to fly United from Phoenix to Los Angeles. Here is the problem. Since I was flying international, I thought United would allow me to take 70 LB because that's what is allowed on Thai but they didn't let me do that. They said that it was a domestic flight from Phoenix to LA and would only allow 50 LB. They asked for another 1000 dollars to check in my luggage to my final destination, Bangkok. I, of course, didn't want to pay that kind of money so they checked my bag only up to LA and I had to pay about 150 bucks for the extra 20 LB weight. I then had to claim my luggage in LA and then re-check in with Thai and I didn't have to pay any extra money aside from all the hassle of check-out and check-in again.
Is this normal procedure when you are flying international? What's the use of Thai allowing 70 LB when you can't do that with your connecting flight or is it just United trying to squeeze some of my hard earned money? What's the best way to avoid this kind of situation again aside from only taking 50 LB? Is there any clear guideline on connecting flights?
