"Sakthisagar", get you facts right, supreme court of india ruled that "Hinduism represented a way of life", and funny thing is you are talking about unity, check your posts, if someone disagrees with you you start talking BS about that person, tonyHK12 being an atheist for me does not imply anything -ve about him,
Sujan vatarapu you are a baby here. you just believe what ever supereme court says! it is influenced by politicians, and the so called minority community in India. So if you dont know dont argue. I never said anything -ve about athiest, I said they are denying themselves by claiming as an atheist. that is about it. When you point a finger three of your own fingers are pointing towards you Please understand that.

Not married yet. GC approved much earlier than others.
I see good news in both these sentences.
Just kidding.
Student visa option will work for you, also even if you get married
H1 is always a option to bring your wife here.

Sometimes in your life you make bad decisions. It happened unfortunately, because my PD is June 2004 EB2 and when dates became current last year, I thought it needs to move just 3 months to have my date current and as per DOS release there were only 3400 visas in EB2 for 2004.
Unluckily I chose for CP instead of 485 and now lying in a dark well.
Anyway please don't sympathize, I'll certainly come out of this situation very soon.
Pls check with your lawyer if you can change to AOS from CP... Then you'll be entitled for all the AOS benefits.. I know few of my friends did filed for CP instead of AOS and maintained their H1/H4 status... So no choice is good or bad.. it keeps changing :-)
Since AOS can convert to CP.. I think it should be possible otherway too...

But he doesn't have any voice,,,
Says who?
We don't even advocate for anything, just post things on the forum. IV has given us immigrants a platform - many of us don't even know it, let alone using it.
If we want to stay in this country, we need a president who can take this country progressively to the future instead of "lets take the country back" "this is not the country I grew up in" rhetoric! If this country goes backwards in time while the rest of the world embraces progress - guess what? - No use having a GC here.

Do not think anything wrong in voting. Atleast so many IV members are again active due to this voting. No harm...
It is not about "Is voting on OpenCongress right or wrong?".
If we had enormous resources (both money and human) I would not have cared people voting on this. We EB based GC seekers are a small group of people. On the top of that a very few of us actually do something that can alleviate our GC situation.
If people efforts are going to be diverted on actions like this, we may loose some of them when IV action comes in.

India was demanding latest fighter jets (F-22) but US can offer only old version F-16,F-18 to India. Basic reason for US denial to latest technology because of India -US relation and their status .US only offers new technology to its close allys. I think it was prudent move from Indias part to get latest and greatest technology. To get these new technologies US congress needs to pass law and define India as close ally.
F-22 is newer version of F-18/F-16??
F-22 is Air superiority Aircraft and India is seeking Multi-Role Combat Fighter!
Whatever you are smoking dude seems real good stuff! Pass that sh1t over here!!

The skin test is mandatory. Also, your blood test results might take a day or two. I really dont think you have any option but to ask her to come back a few days early.

No I am not his agent. We were expecting this information from some credible source. I did not know your wife runs and maintains a web site when she get time off from her AmWay/QuickStar business. I am referring to ---- http://www.assureconsulting.com/faqs/h1b_transfer.shtml
Thanks but in future please lead us to govt/fed web sites. Now from here onwards, I am not going to reply to your notes, you simply do not deserve it!

Ok..., but can you tell me how they are approving cses for PD EB3'2003 or Any EB3 cases daily, when EB3 is 'U', do you have answer for this.
Since ther is plenty of approval going on everyday.
They are not following any PD for the last 3-months approval, I don't believe any rule they have. Now they are already under pressure , and the pressure started already. They have to clean up.I don't think they will wait untill next year June, since Election is on Sept'2008.

I know this is not the right place..but I didn't know where else to post this. Sorry about that.
Has the congresswoman been contacted for this rally? She would be a powerful voice to have on our side.
I am sure the IV core team has thought about this...but I didnt read about it anywhere on the forums. If there is something, please point me to it.

Your employer will have to file a PERM and I-140 and once I-140 is approved in EB-2 with earlier EB-3 PD, request USCIS to adjudicate your pending I-1485 using the newly approved EB-2 I-140. No need to file another I-485 if you already have one pending.
Regarding the fee, there is no filing fee for PERM. All the costs are related to advertising and lawyer fee. I have no idea how much the fee for the whole process is or what attorney's charge as I have never paid anything for any of my immigration process so far (11 yrs in US). Technically, you are not supposed to pay anything, only employer should pick up the fee. You can pay the premium processing fee wherever applicable.
Thanks for your detailed reply. Till now I have not paid for anything for my GC. I have been here since last 12 yrs. My employer is picking up the cost for PERM and I140, as you said I may pay for premium processing for 140 if I opt it that way. My concern is, he said we need to file I485 also as my old 485 is in old format (paying for EAD renewal and AP), not sure about that.
So we do not need to file a new I485 if EB3's 485 is pending ? After I140 is approved under EB2, we just need to request USCIS to look at this new application with old PD to approve EB3 485 ?

Sorry if this is a stupid question, I am a new member
My PD is 02/01/2005, my labour cert got approved in 03/01/2006,
I applied EB3 I40 on 05/18/2007 and got approved on 05/23/2007
Considering the scenario is my I140 invalid?

No, it is not mandatory, but I suggest your renew it if you do not have H1B visa so that you can have it readily should a need arise to travel in emergency.
My AP is expiring very soon. I do not have any travel plans to India in 6 months from now. Is it mandatory that I have to renew the AP before the old one expires?
Thanks in advance.
Ram

Please check with both Immigration attorney (for 485 withdrawal), and a divorce lawyer in India.
I believe that if the marriage was conducted in India, but US court issues the divorce decree, such decree is not automatically recognized in India. You might have to file for such a decree in India too.
Personally, withdrawing now, and reapplying is a better option. You will be playing Russian roulette if you decide to wait for some time to "withdraw" -- as USCIS could suddenly make dates current (remember last year), and approve a bunch of application. Of course, consult an Immigration lawyer to see if you can withdraw and re-use the same application (140) later. If not, withdraw and start a new GC (using current 140 as basis for priority date) -- you could even get a EB2 classification.
