Process stops if you get laid off and No grace period - No matter whether you have a PhD or Masters from a U.S. university and have been stuck in the green card process for 10 years. If you get laid off after all your contributions and frustrations you are automatically "out of status" that very second, and are expected to LEAVE THE U.S. IMMEDIATELY, doesn't matter if you have kids in school, a mortgage, etc. You'd better leave immediately or you risk being deported and "barred from the U.S." for 10 years (didn't know? Look at the law)

What do you mean by "Most people have run out of H1B and will have to change jobs on the extensions"? I thought that as long as you have a approved I-140, you could continue to extend your H1-B beyond the 6 years while you are waiting for your PD to be current. Isn't this true? Please explain.
That's probably the path most people with (EB3 2003 onwards/EB2 2004 onwards) will take from now on. The only hurdle is there is no clarity about the law regarding H1B extensions granted on an approved I-140. Most people have run out of H1B and will have to change jobs on the extensions. I hope USCIS issues a clear guidance on this issue. Also you might not have to let go of the priority date if your company is kind enough.

pbuckeye, , You are still more concerned about what immigration body shop has to say than the facts and numbers on the ground. I am confused
This whole thread is about what Ron Gotcher published. I didn't start this thread. I am only contributing my view that based on available information some things make sense and some dont. The things that do make some sense is wastage of visa numbers in 2010. We have some facts to support the "theory" but not enough.
What doesn't make sense is Ron's assertion that USCIS wasted 13K EB visas in 2009. Facts simply don't support that.
Does this help? (Again this is my view... don't want to push it onto others)

i dont think there is a hard and fast rule as who gets what of the spill overs..
USCIS makes it as.depending on the backlog..
so anyone planning to sue is wasting his time!

In Singapore, the ministry of manpower (MOM) issues a credit card size Employment Pass (EP) card/Work permit. This card enables every one NOT to carry passport at all times.
For citizen/permanent residents in Singapore, the government issues pink and blue cards called SING PASS. Which enables them to prove their identity.
We need some kind of cards in USA too, which show our identity and work status. Why don't we make this part of IV agenda. This would enables us to have some peace of mind.
We know, we cannot carry passport at all times (work, outing, groceries etc).
We must do some thing with this too.

Totally agree, very nicely put. They will hear - listen if we present ideas that are pertinent to the existing situation. Nothing more pertinent than the housing mess. No one cares about old jaded ideas like "high talent" etc.
Can people in California approach Zoe Lofergens office with the idea?
On my part I will start sending letters and emails to the law makers.
Some one in the core has to take the lead and give some direction to this effort......
Do not regret if six months from now the housing crisis has cooled a little, no one will listen to us then. We would have wasted another chance. Do not take it for granted that now Obama is in office, he will do smoething about our problems.
If you are from california plz make a call. Or if you know some one have him/her call to her office.
We need to keep moving ahead on this one.

this bill will never pass at-least in the next 2 years! i can give you a guarantee on that!
these are just bills that the politicians introduce to showcase their views , there are already a few bills in the house that would eliminate extended family immigration etc, never gonna happen
no immigration bill is going to pass before 2010 ,and even after that it'll fall into election time
and become a political issue like in 2007
if there was no recession there would surely have been a serious immigration bill doing the rounds and would have pretty much cleared through ( after GOP figuring out that their screw up on CIR 2007 cost them the elections) but now with the F**K**D Recession everythings gone down the drain
Bad luck Bad timing

I have lived in VA before and know how much of a mess it can be to commute between VA and DC.
However, for this specific event, would local members or those who have had experience attending advocacy days last year recommend to solely use public transport to get to the DC/Cap Hill area or would renting a car be of any help. I was thinking of just renting a car to just get from airport to place of stay and then use public transport on Mon/Tue to get to DC.
LOOK FORWARD TO SUGGESTIONS as I need to plan my travel.

Got an RFE on 9th sept after several SLUDs in first week of september. The RFE asked for paperwork to establish that I maintained legal status during my student years. USCIS received the response on september 30th. The case status chaged to 'response review'. I have had sevreal sluds since them but no approval yet.
Almost 2 weeks since response to RFE was received. Hmm.. You're close to be greened.. Good Luck!

Dear Mrs. Hillary Clinton
Heartfelt thanks for making such an effort to answer consumer grievances. My Admiration for this administration and their efforts to improve communication is growing exponentially every day. God Bless you and God Bless America.
We are wringing these questions in effort to understand the VISA allocation processes followed by DOS. Also how it affects effectively petitioners live to plan their future, travel, Buying house etc...
1.0) Is IVACS primary application for tracking VISA requests from USCIS, Consular posts?
Rationale: Any Software/Application used by DOS should be single source for data entry of all the new application.
1.1) Does IVACS system (DOSs Inventory system) connects electronically to USCIS system, Consular posts or NVC or any other agencies for VISA demand requests?
Rationale: Any Software/Application used by DOS need talk to Client System (USCIS, Consular posts, NVC or other agencies) every month system for effectively moving VISA bulletin every month.
1.2) In Absence of Interface Does IVACS system receive VISA demand sent manually through flat file or spreadsheet?
Rationale: In absence of electronic interface DOS need to manually receive data for effectively predicting VISA bulletin every month.
2.0) How many Employment-based I485 VISA demands are pending at USCIS, NVC, Consular posts?
Rationale: We are trying to get Employment based pending applications.
3.0) IS this last Pending EmploymentDemandUsedForCutOffDates.pdf on 4/8/2010 - http://www.travel.state.gov/pdf/EmploymentDemandUsedForCutOffDates.pdf includes all the Employment based I485 VISA demand?
Rationale: We are trying to confirm data received are all inclusive.
4.0) Can DOS Enhance/publish table for total number of VISA available as on report preparation date, rather than total Fiscal availability. As per table showed below,
Rationale: This will help applicants to estimate date of approval and plan for buying house, make major move etc.

5.0) Can DOS generate monthly VISA returns report from USCIS, NVC, Consular posts or any other agencies that demands Employment VISA?
Rationale: This will help us understand how much visa were available for reallocation.
6.0) INA section Sec 201 (2) mentions usages of visa per Calendar Quarter with maximum limit of 27% per quarter. As EB2 & EB3 categories are retro gassed Are Minimum 140k/4 Visa's consumed every quarter? If no which section of INA being applied to not to do so?
Rationale: To understand DOSs interpretation and application of the law.
7.0) Where we can find DOS published monthly EB/FB permanent residency VISA demand report with country of chargeability, Employment based category (for e.g. EB1, EB2, EB3, ), similar to report published by DOL.
Rationale: This will help applicants to estimate date of approval and plan for buying house, make major move etc.
8.0) What is rational of EB3-India Visa allocation only approximately 100 a month? We feel that before EB3-I become unavailable it should get 140*7%*28.6% = 2802/12 VISAs every month. EB3-I VISA reductions from Inventory reports before their Priority Date is as follows,
a) Between Inventory Published 03/12/10 & 01/30/10 = 100
b) Between Inventory Published between 01/30/10 & 04/08/10 = 100
Rationale: This will help EB3 applicants to estimate date of approval to plan their future for house Purchase or major move etc.
9.0) How do you propose to reconcile the pending data reported by DOS and USCIS.
We are Comparing data from two sources USCIS published pending inventory and DOS published monthly determination, And we have Found data Differences for following categories,
USCIS Pending for EB3-China as on March 08, 2010 === 5,575
DOS Pending for EB3-China as on March 01, 2010 === 8,900
Rationale: Closing gap in case of data error.

I had similar problem with United last year. I was flying thruogh Malaysian airlines and United charged me for extra 20 LBs. But it was checked in till India.
Delta is more helpful that way, one of my friends family had separate tickets on Delta and Malaysian, but the delta checkin guy checked in for both flights upto India, and even allowed the 70lbs on the delta part of the flight.

very well pointed out! maybe there is more to this than meets the eye, because the lawsuit doesn't seem to mention this violation. Or is there a remote possiblity that the lawyers havent done their math?
Ofcourse, this can become the main bullet of the law suite gun.. but hold on before firing it... It can backfire to us... End result can be unwanted... Worst Scenario could be revoking all GCs granted in June and few days of July... multiple lawsuites !!! --- AND increment in the BACKLOG where you and I and everybody in this forum are still stuck.

I-485 Applied after July or not yet applied.

From all my analysis i had 20k-45k number in mind (for Aug/Sept). A large portion of it for EB2-I (could be as large as 25k for the whole year 2008)
sachug22 - Your's and vldrao's analysis has been right on the money.
Now it is all about 'how quickly' the USCIS can process these applications. Looking at last July, there is hope !
30K for EB2-I (Assuming rest goes to EB1,EB2-ROW,EB2-C) can be substantial.
