    Thunderbold, Sorry for your situation. Here is my observation/suggestion.

    Being an immigrant you have broken the law by hiring someone to work illegally. Didn't you and your wife break the law?

    You have already witnessed a child abuse and now pondering whether to report this to a law enforcement or not. Again you are breaking the law by not reporting a child abuse. Remember, abetting a crime is also a crime.

    This country has given us so much including good wealth and health(except GC) and we enjoy every thing, but in return what we do is to do these kind of illegal activities.

    This country let us and our spouse to work, make hell lot of money. I am not saying we are making easy money, but after having two incomes, we run around with coupons and look for cheap things or do things that are cheap. WHY?

    What are we going to do with that money man? This is nothing but a greediness.

    Anyway, your child has gone thru a nightmare and as a parent/father you MUST report this to a law enforcement office. You can not let this child abuser go scot-free.

    Note: When you can hire a nanny that is legal/citizen for $350/week, then why did you hire someone illegal?

    And we are sending letters to USCIS saying they don't follow AC-21 rules (not law) properly !!!

    According to DHS statistics there are around 50,000 EB2 lndia Labors in 2004 and 2005 each. So ppl with 2005, 2006 priority dates you can wait around 6-7 years for ur priority dates to be current with annual limit of around 5000 for EB2 India.

    The lawsuit can be filed by your American Civil Liberties Union Member or ur aunt or uncle or mistress who is a US citizen. U guys and gals with 485's will not be there in the lawsuit but will benefit if the lawsuit wins.

    Doesnt sound correct. Perm started March 2005 and for the entire 2005 year, i saw somewhere that the total number of LCs filed were close to 10-15K, for all countries...so i dont know how you arrived at this 50K number, only for EB2-India...

    Per my knowledge, There is no RULE that USCIS has to assign priority date of 140 to subs case , instead its original LC date... I found on Fragomen website too...

    The above part of your submission is not true. If you read the I-485 Adjudicator's Manual, you will find that the file is already opened and input into the system at this stage. Otherwise dwhuser would not have received I-797 Notice of Action.

    In theory action on a case should be sequenced by priority date and then received date within the priority date batch. However, nobody knows for sure how USCIS works each case.

    fromjaija, When data is entered, and the notice is generated, only limited information is entered in the system. PD is not one of them. When I said "file is not opened", I meant that no one has yet reviewed the file. Note that for most cases PD is not a controlling factor. It is only the unfortunate ones from retrogressed countries that they have to wait for PD to be current. For everyone else, once file is reviewed, if all documentation is in order, case is cleared. Once a file is reviewed, if it has to wait for PD to be current, it is placed in sequence of PD. See USCIS SOP on the link below, which even tells what color of paper clip to use, etc. (though it is a bit out of date).

    The letter actually does not mention all degree requirements have been fulfilled. This left me really upset (I asked the dept to fax it directly to company, so I had not seen it).

    It says "XYZ completed all coursework requirements for his PhD in EE at the University ABC, and deposited his thesis on April 11 2007. His degree should then be officially conferred in May 13 2007"

    Obviously course + thesis = all degree requirements for PhD, but I wonder if USCIS might question it. The company's attorney (a highly reputable company) okayed the letter and he said denial is unlikely and that they will either approve it or issue an RFE; but based on my readings of other posts I think there is a fair chance that it might be denied.

    The irony is that I got a letter from the registrar on April 16, but by that time the attorney had already filed with the weaker letter. I asked him to send the other one when quota was still available but he said it was unnecessary.

    Please anyone with similar experience comment.
    Well I don't know how it works. If the letter actually goes as a proof to USCIS or it simply stays with the lawyer. I would say, just wait and watch now. USCIS might ask you for more evidence. They would not simply reject it. SO don't lose hope.

    I don't have words to show my gratitude and appreciation for IV team.

    On July 2nd, I was so upset. I did not have a clue of what is going to happen.

    Then I came across IV. I joined it as I was joining any forum remotely related to immigration issues.

    Logiclife is right, in the beginning it's difficult to realize how important IV is. But as time passed I realized the strength of IV.

    When employers, attorney, doctors all were busy making money out of our misery, dedicated core members and others in IV were preparing to take our cause forward and to fight till we got the justice.

    Today, And I am glad to be a part of it...
    I am with you guys for just 15 days, but I feel empowered.

    Today, I was exuberant, and I don't think this would have been possible without so much effort, unity, perseverance, and enthusiasm in our group.

    I am going to be a lifetime member and contributor to the cause of IV family.

    I run my family in US and understand it's impossible to maintain a family and make progress in the target areas without proper money flow.

    To help in that area, I am making first time $500 contribution and then $20 per month.

    Even I was wondering same thing- Notice Date or Received Date. USCIS website says Received date is taken into account while looking at service centers processing times.
    Here is exact line-
    "IMPORTANT: If your receipt notice date is earlier then the processing date shown, we suggest you call our USCIS Customer Service Office at 1-800-375-5283 for assistance."

    Of course, I personally wish that Notice Date takes precedence as it is not our fault that one file just kept on sitting and in saga of moving dates and PD, each day makes a difference.
    Well, that may not be quite correct. Service centers claim that they process cases in order they receive them. Receive Date on the receipt is the official RD (the mail room receive date) by USCIS. It is not the date case was received by a center. In the above case, files were just waiting somewhere between Aug 17 and Oct 16. Texas center perhaps opened the case on Oct 16, entered it in the system and sent out a notice. Online status perhaps shows "...your case was received on Oct 16...". So, as far as Texas center is concerned they received the case on Oct. 16.

    Thus, as curent processing times are at August 23, 2007, dwhuser case file is yet to be opened. Since file is not yet opened, no one yet knows his/her PD (it is nowhere other than on paper files). So the case waits - his/her PD may get current and pass. Of course, Aug 17 '07 to Oct 16, '07, was not dwhuser's fault, but it put him/her behind a lot of cases whose files were accepted/opened by a center in the meantime.

    Why so? Because USCIS prime systems are not designed for huge volumes, or PD's so much in the waiting.

    I believe my case is pre-adjudicated.
    My lawyer says she has a way to contact TCS but not to NSC.
    Is there any way remind NSC about my case becoming current in september 2009?

    If your "real" receive date (what you see online as "your case was received on...") is within the published processing dates for your service center, and your case is straight forward, most likely it is preadjudicated. In that case, as their SOP says, they put them in PD order in waiting for the visa. See the SOP below (which is a bit out of date). You are pretty high in PD seniority. you should get a good news soon. Best of luck.

    I also looked around for subLC, could not get one and had the same state of mind. I was not willing to take risk for it, like leaving my current job etc. so I know first hand the exact state of mind.

    regarding ur post: the point u r missing is the lcSUB was legal till middle of july 2007. It is not any more. At this point, it is like crying over something which is stopped 2 years back.

    if you think from a balanced mind, that "visa recapture" and "end of discrimiation based on country of birth" can end woos to all of us.

    As far as your argument for under representated countries, yes they do have visa lotterry and for your kind knowledge, india is not listed for this.

    Lastly, would appreciate if you can update your profile and make some educated arguments.

    Yes it was stopped in 2007. But it still has its shadow. Back in India Did you leave in area where there was shortage of water? All I said is do not call them as jealous. They have valid grievances. If they want they can fight.
    Profile is not needed for an educated guess. Any way I became a citizen last week.

    I just want to generate enough internet chatter so that the issue of substitute labor will come on CIS radar. I know for sure that a huge fraud was perpetrated during July 07 fiasco by some unscrupulous consulting companies who sold pre-approvevd labors like frozen pizzas. Just heat and eat.

    And I also know for sure that IV has gained enough publicity that CIS folks might be tempted to check it now and then. May be they will take notice of this thread and start investigation of all the subst labors.

    I surely am pissed as hell on somebody who came to this country in 2007, and got his/her GC by paying money for some 1999 pre approved labor. I will fight on.

    This is only creating divison and nothing else.

    Mr Unitednation takes the advantages of ignorance (in immgration law) of most of the forum members and spreading wrong information in both web sites.

    Of course he is very informative, however he is very biased and having wrong openion that EB3 India has stolen EB3_ROW number in previous years as he belongs to ROW. He wrongly assumes that till EB3-ROW becomes current EB2 & EB3-India will not see any movement. He thinks no one knows the rules, laws ect..and he is only one knows everything. The actual fact is most peoples have been doing research on retrogression like him last two years and not having enough time to reply his post. To fuel his openion DOS is violating the section 202 of INA and no one cares about this including IV core team.

    Logiclife, thank you very much for the encouraging words and your commitment to our cause.

    I had the good fortune of attending the IV Advocacy days (albeit only for one day) in DC and walking side by side with great people such as logiclife, Aman etc. and experiencing the amazing feat performed by most of the members (naming a few, please feel free to add more...):


    Contacting the lawmakers, confirming appointments.


    Being cheerful, yet completely focussed on the task at hand.


    Being mindful of what to mention to the lawmakers or their representatives.


    All this was accomplished with the limited resources that IV has in terms of volunteer and monetary support. I, like many of the people here, was skeptical of how IV spends the money that is being donated by many donors we see on this forum. It was an eye opener to me when heard that we are doing the advocacy event after 3 long years because of the limited resources we have. I mean, think the 40,000+ users we have on this forum. If each one of us members donated $1, it would have pretty much covered the advocacy day costs. Instead, I read that we could collect only $20,000 for this event (even after most of people paid $50 at a minimum!).

    I am not a donor on this forum yet, but I would like to be one just to support the activities of IV. I am more than convinced that the money I will spend will be put to good use for the good of this community. Mind you, many of the IV advocacy day volunteers had already received their green cards, yet they are fighting for me and you. What good would it be if we still continue to sit on the side and not support such wholesome activities made by these sincere guys? Hats off to IV (and the leaders of IV) for providing us with a great platform and opportunities to make an impact and make out issues heard by the lawmakers.

    So, I request you all to take some action to help IV and help yourself, in turn. If you have any misgivings, by all means direct questions to any of the IV leaders and I am sure they can provide answers..

    Lastly, I really liked the "passion" part of logiclife's message very much and would like to end with a quote about passion:

    "Swami Vivekananda said, "Give me men of passion." Passion means a passionate nature, that if I do this, I must do it perfectly. I must do it as well as I can. I must do it now. And promises do not constitute work. He who wants to give must give now."

    Be Unreasonable & a cause of progress, not just a beneficiary.

    Hello everyone,

    I will explain the title of this thread in a minute (the unreasonable part) but before that I would like to share my experience in DC last week during, before and after lobby days.

    A few weeks ago, when Aman called me to join him in lobby days, just like many others, I was having a difficult time scheduling vacation days off from work. I somehow convinced my boss to let me take those days off and finish the work in the weekend prior to June.

    The Airport pickup:

    When I reached the Airport, Aman and Pratik were there to pick me up. And this is where it got funny and really hilarious. The car was a compact rental car and it was full of printers, laptops and folders -- all in preparation of lobby day. There was barely enough place to sit in the car. After shutting all the doors tight (we really had to compress the luggage and force the door shut) we started driving towards the hotel. And the dome light would not shut off. So everyone outside can see a car full of luggage, printers and people packed like a can of sardines. Fortunately Aman knew the way to the Hotel and we could go there without having to stop for directions.

    Preparation and training on Sunday:

    Sunday was hectic, busy, tiring and very very interesting. I met a lot of new people on Sunday who had come to DC for the first time. And it felt really really good to reconnect with people who we had met earlier in 2007 rally in DC and the earlier rally in San Jose in July. Just felt like I had met my friends from college with whom I spend 4 years. The kind of relationship and chemistry that we have is impossible to describe in words. Crisis and calamity have a way of creating bonds that last a lifetime. We all may get green-cards in next 1 year or maybe 10 years. But I will remember the people I met in DC twice and in San Jose for the rest of my life. And I am sure others feel the same way. These are the people who were sitting on the laptop scheduling lawmaker meetings and connecting members to appointments till 4:00 AM on Monday morning and then back to work by 8:00 AM. We ate whatever was ordered or whatever we found in the hotel. There were people printing business cards in one corner. Others were printing the drop-off material for lawmakers, preparing neat folders for meetings. There was training and mock-meetings going on in another corner for people who had never been to the Capitol Hill before. There was so much purpose and so much goal-oriented motivation in the room, I felt really glad to have not missed this even one out of 3 times we done this both in DC and in San Jose.

    The next two days:

    Over the next two days, I went to about 7 meetings in the House and Senate side and had very very interesting experiences, mostly positive. I cannot share the details of the response for each office as this is a public forum, but I can tell you that having been to DC about 6 times now since 2006, there are Hill Staffers who know many of us and even remember our names. Our conversations do not begin with introductions, but where we left off in our last meeting. More than 60-70% of the offices of Congressmen and Senators know about Immigration Voice and know about the issue. Some offices may have newer staff and not know, and that's where education helps.

    Every single day consisted of going to the Hill from the situation room, (I mostly took a cab, I am lazy that way even if its only 4 blocks), coming back, getting some work done, going back to the Hill, accompanying someone if they are alone in the meetings (it helps to have 2 or more IV members go to a meeting). We worked till 11 PM mostly, and got about 4-5 hours of sleep each night. And that is true for everyone who was there. EVERY SINGLE one. Walking between the office buildings (and they are big) and walking a few times back to the Hotel also made some of us realize (like me) that how out of shape we are physically :):)

    And now to the UNreasonables:




    Every single person who came to DC this time or the time before, or who came to San Jose rally has been told by friends, family and colleagues "Why are you going to DC, let others go, take care of yourself, all problems get fixed eventually, Congress will take care of it".

    They sound very reasonable or try to convince you that they are the reasonable ones and you are being unreasonable by going to the Capitol and working on your cause.

    The truth is...yes, we may be. But we are the ones who will eventually make a difference. If you read the quote from George Bernard Shaw, you will realize that the reasonable men and women will sit around and talk about us, save their time for family and leisure and comply themselves to the system. They will comply themselves to a system that keeps in hanging without a green card for 20 years. They will never be capable of ushering progress.

    The unreasonable ones, the ones like us, who contribute to this cause in various forms, are the gifted ones. We are the lucky ones. For we have the wisdom and the strength to do the unreasonable and get the world to comply to our point of view.


    And flower campaign, the DC rally -- that got bulletin reversed in 2007,
    the popularity of removing per-country ceilings in the offices that exist today and didnt exist before --


    All this a work of men and women like us who are unreasonably resilient, who will not listen to the advise of reasonable men who sit on the sidelines and refresh the Visa Bulletin page every first friday of every month 20 times a day.

    But to those who get it...I have one more quote for you, a final one, I promise:



    I wish the problem of greencard backlogs get cleared soon, but if it doesnt, I will do this a 100 times again and with same or more passion, determination and purpose. Our energy and determination would outlast and outlive the intertia of Congress.

    I, unfortunately could not make it to DC, however, I would love to hear more about what was done in DC and the kind of responses IV got from the offices...... I am positive there are thousands of members who wanted to participate in the event and could not do so for unavoidable reasons - and if the participants could post their experiences, it will give us a better idea and make us feel that we are a part of the efforts too (many thanks to those who have already done so - it is inspiring).
